Mercedes-Benz Class Action Lawsuit Says HVAC Systems Emit Mold Smell

A class action lawsuit claims that the HVAC systems in many Mercedes-Benz vehicles are moldy and emit “foul” smells.

Plaintiffs Rosa Grue of New York, Nicholas Baise of New Jersey, John Dudasik of Illinois, Gail Mahoney of Florida, and Todd Basler of Missouri have launched a class action lawsuit against Mercedes-Benz LLC and its parent company Daimler AG.

The five plaintiffs all drive Mercedes-Benz vehicles and claim that their vehicles’ heating, ventilation, and air condition (HVAC) systems possess a defect that caused them to grow mold and emit a strongly foul smell. The drivers say that the air emitted from the HVAC system is “highly unpleasant and can cause respiratory problems and aggravate allergies.”

Allegedly, the mildew smell gets worse after rain, and the smell permeates the whole vehicle when the air is turned on.

According to the class action lawsuit, the mold problem affects many Mercedes-Benz vehicles made between 2001 and 2018 because most of the company’s vehicles are equipped with the same HVAC system.

The customers claim that when they complained of the mildew smell to Mercedes-Benz, they were advised to fix the vehicle’s air filter or “flush” the HVAC system. However, the customers argue that these solutions were temporary and did not prevent the odor from returning.

The class action lawsuit alleges that Mercedes knew or should have known about the mildew problem but failed to reimburse customers for the costs of replacing the filter or flushing the system, and did not provide customers with an in-warranty fix that would correct the problem permanently.

The Mercedes-Benz class action lawsuit says that luxury car maker knew of the problem as early as 2008 because that year, customers launched an arbitration proceeding over the same issue. The complaint notes that Mercedes-Benz lost this arbitration proceeding.

Additionally, the class action lawsuit says that Mercedes-Benz has received numerous consumer complaints submitted directly to Mercedes and posted in online forums about the HVAC mold smell. To further support their claim that the company knew or should have known that the HVAC systems were defective, the customers note that the National Highway Transportation’s Office of Defect Investigation collected data related to the complaints made by drivers.

According to the class action lawsuit, “despite this knowledge, Mercedes failed to disclose and actively concealed the HVAC system defect from class members and the public, and continued to market and advertise the class vehicles as ‘sophisticated,’ ‘comfortable,’ and ‘state-of-the-art’ vehicles.”

The drivers’ lawyers went on to say in an email to Law360 that, in stark contrast to the vehicles’ adverting, the mold defect and Mercedes-Benz’s response to it is a “staggering betrayal of its so-called ‘luxury brand.’”

The drivers say that they were financially injured by Mercedes-Benz because had they known the vehicles were defective, they would not have purchased the vehicles or would not have paid as much for them as they did. They seek damages on behalf of themselves and all other similarly affected consumers.”

    I own a 2018 Mercedes 350GLE and took my car to a local dealer in Chicago last year to address a foul odor coming out of the vents. They changed the air filters and concluded the problem was resolved. The odor issue is back and it is not yet necessary to change the air filter so I am sure that is not the issue. If this leads to lung problems or other health related problems I would like to know now so I do not continue to drive this automobile.

    I have a 2016 Mercedes Benz C300 that has a foul odor like moldy stink coming out of my car’s air conditioner when first opened in the morning and every starting of the A/C thereafter. My car has only 29,005 miles on it and I bought it in September 3, 2016 brand new from Mercedes Benz of North Orlando, Florida. I went to the dealer this morning and was told they would try to fix the problem if I pay them $619.98 before taxes and shop fees, but will not fix it even with the Class Action Lawsuit that they repair it for free. They said that because the cabin filter was not serviced since new and the service intervals wasn’t completed is their reason to not do it as per suit.
    Can they be right, as hundreds or thousands of Mercedes Benz of different models have the same problem and it does not matter if the service intervals were followed or not, the fact is Mercedes Benz has a design problem, as it only has that problem since 2009 and other year models have no problem with that moldy bad odor.
    Please let me know if I have a solid case against them?

    Please add my to this lawsuit. I have a 2019 GLA 250, and there has been a smell in the car of the last 3-4 months. Mercedes wants me to do an HVAC flush at my own cost. I won’t have it.

    I have a 2016 C300 .. the smell is awful!!! change the filter they said!… the smell still there… and MB won’t do anything about it… won’t be buying another MB !
    did they settled the lawsuit yet.?

      Hi, was yours fixed. I’m having the same problem. The smell is so embarrassing. People are like why does your car smell. It’s awful.

    2015 C300 – the smell is in the cabin when the FAN is not on – smells like wet dirt, not sure if i can say it ‘wet dog’. When the fan is on, the smell is gone, feels like is not getting into the cabin by the forced air. This is regardless from the AC on/off. Besides this, no other smell or issue with the AC.
