Top Class Actions viewers are starting to receive checks from the Kenmore grill class action settlement worth as much as $125.

Qualifying consumers received vouchers and cash payments to compensate them for their previous purchase of allegedly defective Kenmore gas grills covered in the Kenmore class action settlement.

The Kenmore grill class action settlement was reached to resolve allegations that certain Kenmore brand barbecue grills sold by Sears Roebuck and Co. were defective in their design, and that the defect made them dangerous to use.

The Kenmore grill class action lawsuit was filed by plaintiff Michael Oaks against Sears in December 2015. He claimed that certain Kenmore grills had firebox trays that were defective.

According to Oaks, the firebox trays were made of galvanized steel, which was prone to disintegrating and thereby exposed the grills’ propane tanks to open flames. He said that this defect posed a safety and fire hazard.

Oaks argues that the firebox tray becomes defective during the “useful life” of the grill, when the grill should work normally. Additionally, he said that the defect occurs when the grill is being used and operated normally and properly.

According to the Kenmore grill defect class action lawsuit, Sears knew or should have known that the grills were defective, but sold them anyway.

The plaintiff said that the company was negligent in selling consumers a dangerous product, and “actively concealed and failed to disclose” the fact that the firebox tray was defective, both before and after consumers purchased the product.

Additionally, the Kenmore grill defect class action lawsuit alleges that Sears did not repair the grills when the firebox tray became defective, forcing consumers to pay around $300 per repair to fix their affected Kenmore grills.

The plaintiff claims that customers did not get what they paid for, which they thought was going to be a useful grill, but was instead one that was defective, dangerous, and required expensive repairs.

Sears agreed to settle the Kenmore grill class action lawsuit and discontinue the manufacture and sale of the Kenmore grills with galvanized steel firebox trays, but continues to deny any wrongdoing.

Sears maintains that the grills were not defective in any way. The company reportedly decided to settle the Kenmore grill class account lawsuit to avoid incurring additional costs of litigation.

    I never received anything… and yeah – the grill housing rusted right through. I can look straight down past the burners at the propane tank

      I also sent all paperwork and photos in back in March of 2017. I have not recived or heard anything and my grill is now un-operable. Whats up with this?

    I just found out about this lawsuit . My grill cast iron grill crates got rusted and crack within one year so last year I bought some new ones and it happen again. These came out defected. Is it too late to file a claim against them ? Does anyone know ?
