Members of the Isle of Capri Casino Fan Club who placed qualifying winning bets on an Organic Dice machine may qualify for payments under a recent class action settlement.
Plaintiffs Daniel Brna, Ramon Fernandez and James Scott filed this Isle of Capri Casino class action lawsuit earlier this year. All three plaintiffs are members of the Isle of Capri Fan Club, a customer loyalty program that rewards patrons according to how often they play casino games. They allege they were overcharged commissions on winning bets placed on a particular electronic gaming device.
According to the plaintiffs, an electronic game called Organic Dice charged more than the five percent commission stated in the game’s rules for winning buy bets. They claim Organic Dice charged them five percent of the winnings instead of five percent of the bet. The alleged miscalculation resulted in players paying six to 10 percent of their bet for each winning bet, the plaintiffs say.
Organic Dice is an automated, electronic game that runs various gambling games, including craps. It is manufactured by Interblock USA LLC, which is also named as a defendant in this Isle of Capri class action lawsuit.
Isle of Capri and Interblock deny the plaintiffs claims. The court has made no decision as to their liability, and the settlement does not require them to admit any fault.
The settlement requires Isle of Capri to compensate Organic Dice players who meet the settlement’s specific requirements. Depending on the number of qualifying Class Members who submit valid and timely claims, each qualifying claimant will receive a payment of either $15 or $30.
Class Members can exclude themselves from the settlement or object to its terms by submitting a written request no later than Jan. 19, 2018.
Who’s Eligible
The requirements for Class Member eligibility are very specific. Class Members eligible to make a claim are persons who between July 8, 2015 and Jan. 22, 2017 were members of the Isle of Capri Fan Club and placed at least one winning buy bet while playing craps on an Interblock-made Organic Dice electronic gaming machine at the Isle of Capri Pompano Park casino.
A “buy bet” is a type of bet in a craps game that is placed on a specific point for numbers 4, 5, 6, 8, 9 or 10 and that pays at or near true odds. The bet wins when the chosen number is rolled and loses when a 7 is rolled.
Persons who were not Isle of Capri Fan Club members during the applicable time period are not qualifying Class Members. Losing bets and bets placed in any game other than craps do not qualify.
Potential Award
Up to $30.
Qualifying Class Members will receive a payment worth either $15 or $30, depending on the total number of valid claims submitted.
Proof of Purchase
Class Members are asked to provide any supporting documentation of their qualifying bets. However, supporting documentation is not required.
