The Monsanto Company and Bayer Corporation are facing a new Roundup herbicide lawsuit filed by a man in the U.S. District Court for the Eastern District of Missouri.

Plaintiff Jake H. filed the Roundup herbicide lawsuit demanding a trial by jury. The lawsuit was filed on July 2, 2018.

According to the Roundup herbicide lawsuit, Jake is a resident and citizen of Weber County, Utah. He says that he sustained personal injuries through the exposure of Roundup that contains an active ingredient known as glyphosate capable of causing cancer among other serious complications.

In fact, in 2015, Jake says that he developed and was diagnosed with non-Hodgkin’s lymphoma.

The roundup herbicide lawsuit was filed on multiple counts including design defect; failure to warn; negligence; fraud, misrepresentation, and suppression, and violation of the consumer fraud acts.

Overview: Roundup Herbicide

One of the most widely used and popular herbicide products used around the world is the Monsanto Company’s Roundup. However, the product contains an active main ingredient, glyphosate, claimed to cause increased cancer risks, including non-Hodgkin’s lymphoma. Those most at risk include those who are in direct contact with the product, such as farmers, gardeners, and other agricultural laborers.

Although it was once believed to be a fairly safe herbicide, there have been more than 1,000 Roundup cancer lawsuits filed in federal courts throughout the country. Monsanto lawsuits have been filed by agricultural workers, gardeners, and laborers who have suffered and developed non-Hodgkin’s lymphoma or other cancers from the proximate and direct exposure to Roundup.

The Monsanto Company has tried to appeal a California judge’s decision to mandate the placement of labels that carry warnings of Roundup’s risks to causing cancer. However, those warnings were added in January 2017. Allegations against Monsanto claim that the company failed to warn consumers about the risk for the development of cancer with Roundup exposure. Additionally, he alleges that glyphosate can cause cancer and that Monsanto knew of those risks but failed to inform the public, government agencies, and farmers.

However, the International Agency for Research on Cancer (IARC), a division of the World Health Organization (WHO), has since labeled glyphosate as a “probable” carcinogen. The United States Environment Protection Agency (EPA) has also said that current individual exposure is surpassing safe and established glyphosate limits.

According to the EPA, “In California, glyphosate ranks high among pesticides causing illness or injury to workers, who report numerous incidents of eye and skin irritation from splashes during mixing and loading.”

Cancer types associated with Roundup exposure have included:

  • Bone cancer
  • B-cell lymphoma
  • Multiple myeloma
  • Leukemia
  • Non-Hodgkin’s lymphoma
  • Renal cell carcinoma (kidney cancer)
  • Other cancers

According to the American Cancer Society, non-Hodgkin’s lymphoma also referred to as NHL, is cancer in the body’s white blood cells known as lymphocytes. Lymphocytes are part of the body’s immune system that helps fight off diseases and infections. Symptoms of non-Hodgkin’s lymphoma include swollen belly; chest pain or pressure; weight loss; fever; anemia; enlarged lymph nodes; and shortness of breath or a cough.

The Roundup Herbicide Lawsuit is Case No. 4:18-cv-01064-HEA, in the U.S. District Court for the Eastern District of Missouri, Eastern Division.
