Recording phone calls is an extremely common practice for businesses, and it’s not necessarily illegal or nefarious. Often, businesses record phone calls for their records or to evaluate employee performance. This is often included in the required warning about a call that is recorded: the speaker will warn that “this call is being monitored for quality assurance” or some similar variation.

In many cases, these warnings are actually automated, without even allowing time for a person to say “yes” or “no.” But verbal acceptance is not required here. Simply staying on the line after a warning has been given is enough to grant consent. If you do not want your call to be recorded after hearing a warning, just hang up.

If you do not hear a warning and believe the call was recorded, the company may have violated California phone recording regulations. Lawsuits over violations of phone recording laws have targeted some major companies, and some of them have ended in multi-million dollar settlements.
