1800 Contacts Class Action SettlementCalifornia consumers who submitted valid claims to the 1-800 Contacts call recording class action settlement will see a late Christmas bonus in their mail boxes soon. Settlement checks worth up to $606.57 were mailed to eligible claimants beginning Thursday, Jan. 16.

The checks are part of a class action settlement reached between 1-800 Contacts and California consumers who called or received a telephone call from 1-800 Contacts Inc. between Aug. 15, 2011 and Sept. 10, 2012. According to the class action lawsuit, the company secretly recorded these phone calls without notifying consumers, in violation of California privacy law.

The company denies the allegations but agreed to pay $11.7 million to resolve the litigation.

A federal judge granted final approval to the class action settlement at a Dec. 16 Final Fairness Hearing.

A total of 13,665 eligible claims were filed before the Nov. 14 deadline, according to Settlement Administrator Rust Consulting Inc.. Each eligible Class Member received an equal share of the remaining net amount ($8,288,719.16), after the deduction of attorney fees, court costs and administration fees. That puts each check at $606.57. Those that receive less are encouraged to see the FAQ concerning taxes, available at the Settlement Website: www.1800ContactsSettlement.com.

    Yeah these guys are crooks bc me and my wife should have both gotten paid bc we use a landline but none of us got it but for none of us to get it is ridiculous and we live in los Angeles. And for them not to pay one of us is ridiculous when we order all of our contacts from them. They could have sent out one for my number period and if they recorded several people from my number they should still get paid because it is a landline.

      Maybe you were never recorded. whoever my sister talked to at the law firm told her that not every call from California during that time period was recorded. she personally has no way of knowing if she was recorded or not because her number is blocked when she makes outgoing calls.

    my sister did not receive a check so she called the attorneys’ office. they asked her for her name and phone number and told her that her number was not on the list. you don’t have to go through rust to find out why you haven’t received a check. they told her that not every call from California during that time was recorded. you know how we sometimes get told that a call may be recorded for quality assurance before the beginning of a conversation? that is what happened here. 1-800-contacts failed to disclose that to us. Not every call was recorded. the claimant found out that he was being recorded because he called 1-800-contacts about an issue and the customer service representative who he was talking to mentioned that his previous call was recorded and that they could go back to see what was said. 1-800-contacts submitted whatever number popped up on their caller ID when a recorded conversation took place. My sister’s home number is blocked so if she was recorded she was straight out of luck because her home number wouldn’t have shown up on the list.

    This is just speculation on my part but I don’t think that Rust necessarily had to send out rejection notices for this one because there wasn’t really anything you could submit as proof that your call was recorded. you could have submitted a phone bill showing that a call was made but that wouldn’t prove that it was recorded. I received a rejection notice from the intelius class action lawsuit because they could not match my name to their records and they gave me 10 days to submit my credit card statements that showed that I was billed for extra services.

    carlos, I simply don’t understand why you are in here calling my facts lies. Class action attorneys receive 25 percent of the settlement. please read the court documents for all of the class actions listed on this website. That is not a number that I am making up. It is there in black and white. Rust did not lie to me about taxes. They gave me the option of taking it out or not taking it out. Everyone who got a check received a 1099. They followed the tax laws which are listed on the IRS website. I had mine taken out and can claim it on my taxes next year. That is the law for any settlement over $600.

    If you truly believe that rust wronged you in this case, contact the attorneys who represented you.

    I never tried to deter people from filing. I just simply stated that rust did not keep money for themselves in this suit. iIf you feel like like they did then contact the class attorneys. If rust is keeping money from them, then they too are affected by it since it cuts into their 25 percent. The class attorneys can access information about the bank account that was set up to hold the money.

    I also don’t believe that there is a person here who worked for rust who refuses to speak up based on signing a non disclosure agreement. they become null and void in regards to illegal activity so that employees can report their employers. rust cannot sue you for being a whistleblower.

    Your 9th grade education didnt teach you how to make sense in your grammar.

You are not part of the class because you clearly asked why I did not mention submitting the claim online as that is what most people did. I am here to tell you that most people did not do that because submitting the claim form online was not an option.

    Show you a lawyer who works for 25 percent? I can the show you ones..the attorneys who defended the class in this lawsuit. Class action attorneys receive 25% of the settlement plus expenses. That is not a fable or fallacy..that is a fact. It is in the court documents. If you bothered to read court documents that pertain to you instead of chasing the money behind these class actions suits, then you would know that.

    The final judgement breaks down all of the numbers. after rust’s and the attorney’s costs, there was a leftover amount. That final number, divided by the number of approved claims, is the total that my check was for, minus taxes. If it were a penny less, I would have contacted the attorneys who represented the class (me) since again, they were paid to represent me.

    Of course the attorney general would have complains against rust. they dropped the ball with the mortgage settlement places. that does not negate the fact that the BBB is a joke.

      The AG complaints are not based on one complaint alone, (Jokester.)
      Does Rust really pay you to be on the computer.
      Most lawyers run between 33.3- 50% now a days you must be hiring back yard attorneys.( talking out your a$$ again.)
      A PHD in education and a masters in criminology I think I know the “EDUCATION” system pretty well.
      I don’t chase a dime behind these actions as I was a member who received notice, I simply ran into this web page by typing complaints against Rust of which there are 100’s of pages.
      OH BTW when you mention a companies name it should be capitalized, but I lack in education huh??
      Look how hard this person is trying to deter you guys from filing complaints.
      Funny though how he knows about chasing money so well.
      Are you saying that the people on here are bad people because they do??
      Go back t your corporate hole pal as we all know who you are already.

      Another tip for you guys, The IRS does not force companies such as Rust to charge taxes.
      Its up to the tax payer to pay their fair share of taxes.
      They lied to you again when they told you they had to pursuant to IRS guidelines they are FOS just like this jokester Mark is.

        Carlos, Did you know that court guidelines stipulate that class counsel’s fees PLUS expenses shall not EXCEED 30% of a settlement? This is why Mark repeats the 25% figure over and over…It is usually the amount class counsel charges for their services…their EXPENSES are then ADDED to this 25%…sometimes bringing the total to 27%, 28%, or even 29%..but not to exceed 30% of the settlement amount. Read some of the legal documents, attempt to understand any of it, and when you DON’T, ASK QUESTIONS to the class counsel instead of blabbering on here because you make yourself sound like an idiot by trying to insult people and you make accusations without proof or facts, but you in turn, ask someone else to provide PROOF that Rust isn’t stealing or keeping leftover settlement money. Well, I’d say that your accusations against Rust (calling them thieves), would be the statement that needs to be proven before it’s believed because court requires documentation and an accounting for all money involved in a settlement…INCLUDING MONEY USED FOR POSTAGE. So please don’t hurl accusations until you have some actual facts. Your “facts” do not even come close to an educated guess, but more like a WILD guess. Are you kidding me?

    Ignore this person and like I said sign AG complaints and DOCA to open attention to this company.
    Guess what Mark since BBB is a joke as you stated I just called the AG office and they have several 100’s complaints about Rust.
    Are they a joke as well??
