1800 Contacts Class Action SettlementCalifornia consumers who submitted valid claims to the 1-800 Contacts call recording class action settlement will see a late Christmas bonus in their mail boxes soon. Settlement checks worth up to $606.57 were mailed to eligible claimants beginning Thursday, Jan. 16.

The checks are part of a class action settlement reached between 1-800 Contacts and California consumers who called or received a telephone call from 1-800 Contacts Inc. between Aug. 15, 2011 and Sept. 10, 2012. According to the class action lawsuit, the company secretly recorded these phone calls without notifying consumers, in violation of California privacy law.

The company denies the allegations but agreed to pay $11.7 million to resolve the litigation.

A federal judge granted final approval to the class action settlement at a Dec. 16 Final Fairness Hearing.

A total of 13,665 eligible claims were filed before the Nov. 14 deadline, according to Settlement Administrator Rust Consulting Inc.. Each eligible Class Member received an equal share of the remaining net amount ($8,288,719.16), after the deduction of attorney fees, court costs and administration fees. That puts each check at $606.57. Those that receive less are encouraged to see the FAQ concerning taxes, available at the Settlement Website: www.1800ContactsSettlement.com.

    I still haven’t received my portion of the settlement here in Michigan. This is ridiculous! My American rights were violated along with hundreds of other people and we should get what we deserve! This company has NO right to record mine or anyone else phone conversations. I would sue 1800-Contacts myself, but by signing the claim form, I gave up my right to sue these guys in return for a portion of the class action settlement fund THAT I DIDN’T RECEIVE! There is NO reason why I shouldn’t have a check in my mail box. I should have had a letter mailed to me explaining why I didn’t receive my check or why my claim form was rejected. Rust Consulting need’s to be investigated!

    Lets start a Class Action Suit against the Real crooks here; “Rust Consulting, Inc” for not ~CONSULTING~ the victims about this settlement!

      Pissed off claiminat: I have been told that the funds that get returned to them or they dont pay out goes into a fund that they keep unless the lawsuit stated it goes to a charity fund.

    They are not above the law and can not be allowed to violate the law.
    They have to send you out a deficiency notice or notice of rejection.
    If not they are in violation of the law.

    Have friends that used to work for Rust and its true they are crooks.
    They will not send out any rejected notices and they will in turn keep any extra money left over.
    I cant wait for this company to get sued as well.
    # of my friends one current and two former told me the same exact thing.
    Watch out folks sue these bastards.

    On 01/21/2014 I received a check for $394.27 with taxes already paid. It was easy, I submitted my claim and a copy of the phone bill with the call to 1800contacts highlighted before the deadline.

    Rust Consulting is a hard company to figure out. I did the same thing on the Sketchers settlement with a scan of my original sales receipt and I was denied. I was asked to do it again months later and I was denied again and this was all done before the deadline.

    Still waiting on my check over here in Michigan. I assume because I lived in California at the time, and called to refill my prescription multiple times, I am definitely part of this class. I will give an update as soon as the check is received.

    I had called a few times during the time frame and filled out a valid claim. If I did not get an email turning down my claim, will I be receiving my check today? I have heard that they are shady with their payouts. Is there any truth to that. Please let me know if you have any information. Thanks

      they sent me a tax form to pay $45 in taxes but never sent me a check for the $606!!!

      Lol no you won’t, Monday is MLK day, no mail delivery. Tuesday is the day it looks like.
