1800 Contacts Class Action SettlementCalifornia consumers who submitted valid claims to the 1-800 Contacts call recording class action settlement will see a late Christmas bonus in their mail boxes soon. Settlement checks worth up to $606.57 were mailed to eligible claimants beginning Thursday, Jan. 16.

The checks are part of a class action settlement reached between 1-800 Contacts and California consumers who called or received a telephone call from 1-800 Contacts Inc. between Aug. 15, 2011 and Sept. 10, 2012. According to the class action lawsuit, the company secretly recorded these phone calls without notifying consumers, in violation of California privacy law.

The company denies the allegations but agreed to pay $11.7 million to resolve the litigation.

A federal judge granted final approval to the class action settlement at a Dec. 16 Final Fairness Hearing.

A total of 13,665 eligible claims were filed before the Nov. 14 deadline, according to Settlement Administrator Rust Consulting Inc.. Each eligible Class Member received an equal share of the remaining net amount ($8,288,719.16), after the deduction of attorney fees, court costs and administration fees. That puts each check at $606.57. Those that receive less are encouraged to see the FAQ concerning taxes, available at the Settlement Website: www.1800ContactsSettlement.com.

    Your a joke pal cause any attorney or person knows how backed up the courts are and yes they are severly back logged.

    I filed a claim with my husband we resided in California, I sent an email an they told my claim was rejected, the number provide wasnt on the list. Bogus, but as of today no rejection letters NOTHING!!!

    i’m the same mark who posted in the original 1-800 contacts lawsuit page for months. you could not submit this claim online so I don’t know why you bring it up…unless you are here trolling because you definitely just outed yourself as someone who is not a part of the class. Rust mailed me the claim for as soon as 1-800 contacts gave them the list of people who were affected by this lawsuit. it had to be submitted through fax, snail mail or e-mail. snail mail with proof of delivery was the best method for me. Once I received the proof of delivery, I waited about two weeks to send them and email and ask if they got it. I received a reply in less than 24 business hours. My fiance did the same. People did get letters of rejection. Go to the original 800-contacts page and they are there.

    you have every right as a tax payer to contact the court house and ask to see the court documents. you also have every right as a class member to contact the attorneys who filed the suit. That is what their 25 percent of the pie is for. They have a copy of the list of eligible phone numbers. Saying that the court house is too busy is just an excuse. I can go online, pay a fee, and receive copies of cases within a reasonable amount of time.

    The BBB is also a joke. Business are paying them to keep them in business. It’s not a real government entity that can take any action. People are so gullible.

    again I ask, what did rust have to gain from denying claims? they did not keep any of the money. it was divided evenly among the class.

    2.) LCD Indirect class action lawsuitI did not receive any settlement check for 2 lcd I purchased during the correct period. I had set proof of ownership including receipt from store on one of the items.
    3.) Complaint: Rust Consulting failed to meet the December 2013 date they supplied to mail out checks. No future date supplied.Re: Claimant ID: **********, Acct.#: **********I received a letter from the Office of the Attorney General of the State of Illinois dated July 2, 2013, saying I was eligible for a check from JP Morgan Chase Bank due to the National Mortgage Settlement. I filed my claim form far in advance of the October 17, 2013 deadline. The letter also stated that the Settlement checks were anticipated to me mailed out in December 2013. I called the number supplied by the Attorney General at the end of November to ask for a delivery date. Was told by Rust Consulting they did not have a specific date but they were expected to go out sometime in December. Today, January 8, 2014, I still have not received a check and called Rust Consulting, Inc. again. I was told by ******** that they did not mail out any checks because they were still processing claims and that they were not given any specific date as to when they would be mailing out checks. She also said that it was on December 27, 2013, when they were notified that the claim processing was not complete and the checks were not going to go out by end of December.It is unacceptable for them to refuse to give a future date of delivery. They were hired and paid well to do this job by the State of Illinois Attorney General’s office. They should not take on a job that they cannot complete in a timely manner. And when they miss their published deadline, they should provide a new date of completion. I asked ********, “So you are telling me that it could be another six months for all you know or indefinitely?” She answered, “I don’t believe it will be that long”. I made financial decisions based on the initial date they provided. I would like to know when they are mailing my check. I don’t believe it’s too much to ask. They gave me a deadline, I met it. Now they should be required to tell me when they are going to meet their commitment.

    Correct me if I am wrong but wasnt it Rust Mark who tried to rip off all those consumers in the Chase mortgage scandal??

    I can not discuss who I am because of a confidentiality agreement because I can be sued.
    But what Mark says is completely false.
    I will not confirm or deny what Carlos is saying as I know they can track IP’s.
    Lets just leave it at that.

    Furthermore courts are so inundated with cases that they don’t have time to go back and research bank records as this person may have suggested.
    It’s a known fact that courts only will investigate company fraud when there is a fair amount of complaints about it.
    I highly doubt that 3 people would lie to me.
    Maybe would should start a list of all the companies that we trusted in this country that went bad and got shut down for consumer fraud.
    Guess again I implore you all to sign com-plaints with your AG, and DOCA so that they may start an investigation into Rust and its shady practices.
    What Rust clearly did in this case was auto reject any claims that didn’t reside out of California not bothering to go back and see that we did indeed reside in California on the dates in question.
    Don’t even try emailing Rust because their customer service will not respond as they lack in customer service.
    Trust me guys this company will get what they deserve but it can not start without you.

    sorry that you guys have been misinformed but rust does not keep any money. read the court documents. the total amount was divided up equally between all verifiable claims. any uncashed checks after 90 days are void and the remaining money is sent to a nonprofit account. The defendant never gets that money back and rust does not keep any money. the court has access to the bank account records. i don’t know why people on this site keep repeating that lie. every class action lawsuit has a chosen nonprofit that receives all remaining money. it seems like a lot of people on here like to just submit claim after claim but don’t bother to go through each page of the court documents. rust sent us the claim forms to fill out in september/october. there was plenty of time to submit and then shoot them an email to ask if they received your claim form. i mailed it in with proof of delivery. anything can happen..the letter does not reach them, a fax doesn’t go through correctly..it is up to each individual to be proactive about receiving their money. 16000 or so claims were received and 13000 were approved. it seems to me like most people were approved.

      Its illegal for companies to commit fraud but they do so every day.
      For it to have one of its lackies come on here and defend it is unreal.
      Yes we all know what the court order says but Rust is NOT following it.
      Why does Rust think its above the law??
      Also funny how you mention faxes and snail mail.
      Most people filed on line buddy.
      Nice try with your futile efforts.
      Guys also notice how he didnt mention anything about the law and letters of deficiency or rejections.
      Explain that one pal how they so seem to forget to mail those out.
      Who on this page mentioned anything about filing multiple claims??, another reason why this Rust employee has proved himself to be just that.
      How would Mark even know that people are filing multiple claims???
      Everyone file enough complaints with your AG and DEpt of consumer affiars and watch how fast this company goes out of business.
