permatex class action settlementThe deadline to file a claim in the class action settlement with Permatex, a division of Illinois Tool Works Inc., over the “Made In the USA” labeling of their products is quickly approaching.

If you purchased a qualifying Permatex automotive repair kit in California between March 27, 2009 and Dec. 19, 2014 that bore the statement “Made in USA,” you may be eligible to claim up to $2.00 per kit purchased from the class action settlement.

The Permatex class action settlement was preliminarily approved on Dec. 19, 2014. The claim filing deadline is April 8, 2015 and the final approval hearing for the class action settlement is scheduled for June 26, 2015.

The lead plaintiff alleged in the class action lawsuit that Permatex, a division of Illinois Tool Works Inc., violated various California laws by using a “Made in USA” label on packaging for automotive repair kits that contain less than 100 percent domestic content.

Permatex and Illinois Tool Works have agreed to settle the claims in the class action lawsuit but continue to deny the allegations made by the lead plaintiff. The defendants say that they are agreeing to the settlement to avoid the uncertainty and expense of ongoing litigation.

Under the terms of the settlement, Class Members who submit a valid and timely Claim Form will be eligible to receive $2.00 for every qualifying product purchased during the Class Period. Class Members must also submit proof of purchase for one or more qualifying Permatex automotive repair kit products during the Class Period.

Class Members include anyone who purchased a qualifying Permatex automotive repair kit product in California that bore the statement “Made in USA” on the product packaging. The Class Period includes products sold between March 27, 2009 and Dec. 19, 2014.

To file a claim in the Permatex Made In USA auto repair kit class action settlement, you must submit your claim online or by mail by April 8, 2015. Claims submitted via mail must be postmarked by April 8, 2015.
