product liability lawsuitAccording to news reports, all parties involved in Actos bladder cancer lawsuits filed in federal court have been required to discuss potential Actos settlements before next year’s scheduled Actos multidistrict litigation (MDL) trial.

During this Actos MDL trial, at least five different bladder cancer lawsuits may be consolidated before a single jury, according to the judge’s mandate.

There are over 4,000 Actos bladder cancer lawsuits awaiting trial in federal court, all of which similarly allege Takeda Pharmaceuticals and Eli Lilly failed to warn consumers about the risks of Actos bladder cancer when taking the popular type-2 diabetes medication.

All of these Actos lawsuits have been centralized into one Actos bladder cancer MDL in Louisiana federal court before U.S. District Judge Rebecca F. Doherty. Additionally, Actos bellwether cases have been prepared for early trial dates. A second group of Actos bladder cancer bellwether cases are currently being prepared for trial in May 2016.

In April of last year, the first federal Actos trial resulted in a $9 billion jury award for the plaintiffs.

It was during this Actos bladder cancer trial that evidence was given indicating that Takeda and Lilly destroyed evidence that supported the causal link between Actos use and bladder cancer. This jury award was later reduced to $37 million by Judge Doherty, stating that the Supreme Court would do well to update what the court considers an excessive award in order to more effectively deter large corporations like Takeda and Lilly from engaging in unfair business practices that endanger consumers and the medical community.

Actos Bladder Cancer Side Effects

Actos is a type-2 diabetes drug treatment designed and sold by Takeda and marketed by Eli Lilly. Since the late 1990s, Takeda has aggressively promoted their Actos drug throughout the United States, and with the help of Eli Lilly, Bayer has been able to do the same in the international diabetes drug market.

Over the last 20 years, Takeda and Lilly have reaped billions of dollars in annual revenue from the thousands of Actos users all over the globe. However, Takada and Lilly are now facing thousands of Actos lawsuits filed by consumers who allege they developed bladder cancer only after taking Actos.

In addition to the increased risk of bladder cancer, many Actos consumers have reported other side effects related to using the type-2 diabetes mellitus treatment. These Actos side effects can include:

  • Chronic Kidney Disease
  • Congestive Heart Failure
  • Liver Failure
  • Lactic Acidosis
  • Bone Fracture
  • Rapid and excessive weight gain
