front-loading washer class action lawsuitBSH Home Appliances Corp. is getting close to settling a class action lawsuit alleging its washing machines suffer from a defect that makes them susceptible to mold and/or bacteria growth.

Yesterday, U.S. District Judge David O. Carter granted a stay in the moldy washer class action lawsuit after BSH and plaintiff Diana Tait informed him they had reached a tentative deal. The parties will likely file a motion seeking preliminary approval of the moldy washer class action settlement by early December.

The BSH moldy washer class action lawsuit was filed over alleged defects in BSH front-loading washing machines. The moldy washer lawsuit alleged that some Bosch and Siemens front-loading washing machines are prone to developing mold, bacteria and/or other biofilms that can cause a foul odor.

According to the moldy washer class action lawsuit, the alleged defect can cause washed clothes to stink. The plaintiffs claim the front-loading washing machines do not work as advertised and do not effectively clean themselves. Further, these front-loading washing machines allegedly require extraordinary upkeep to prevent these foul odors from developing.

The moldy washing machine class action lawsuit alleges BSH breached warranties and violated various state laws.

The court has certified a Class of California, Illinois, Maryland and New York residents who purchased a 27-inch Bosch Nexxt, Bosch Vision or Siemens ultraSense front-loading washing machine.

The BSH moldy washer class action lawsuit had been scheduled to go to trial on Jan. 13, 2015. Judge Carter said he will keep this trial date on the docket for now, despite the pending deal.

Last month, a jury ruled in favor of Whirlpool Corp. in a trial for a similar moldy washer class action lawsuit. The jury found that Whirlpool’s front-loading washers were not negligently designed.
