Judge Approves Domino’s Pizza Robo-Call Class Action Settlement

A Louisiana federal judge has granted final approval to a class action lawsuit settlement requiring Domino’s Pizza to pay $9.75 million to Louisiana, Alabama and Mississippi consumers who received robo-calls to their cellphones advertising pizza specials. Customers that submitted valid Claim Forms will receive up to $15 from the class action settlement.
On May 24, 2013, U.S. District Judge Stephen C. Riedlinger approved the Domino’s Pizza Robo-Call Class Action Lawsuit Settlement as “fair, reasonable and adequate,” putting an end to claims that Domino’s franchise RPM Pizza LLC violated the federal Telephone Consumer Protection Act (TCPA) by sending unsolicited pre-recorded phone message advertisements to certain customers.
Class Members of the Domino’s Pizza robo-call class action settlement included anyone who received a robo-call on their cell phone by or on behalf of RPM advertising Domino’s pizza or other food products offered for sale at RPM’s stores to consumers in Louisiana, Alabama and Mississippi.
Class Members that received a robo-call between May 20, 2006 and May 19, 2009 and filed a valid claim will receive a voucher for one large one-topping pizza for in-store pickup. Class Members that received a robo-call between May 20, 2009 and May 20, 2010 and filed a valid claim will receive a cash payment of up to $15.
