Madela Breast Milk BottleA proposed class action lawsuit settlement has been reached between Madela Inc. and consumers who claim the manufacturer misrepresented the safety and utility of its breast milk freezing and storage bottles. Qualifying Class Members can receive up to $10 in discount certificates if they file a valid Claim Form by the June 25, 2013 deadline.

If approved, the Madela breast milk bottle settlement will resolve a class action lawsuit (Baghdasarian, et al. v. Medela Inc., et al.) that alleges Madela made false and misleading statements about its 2.7 oz/80 mL, 5 oz/150 mL, and 8 oz/250 mL breast milk bottles and/or component parts – specifically that the bottles were “safe” and ideal for freezing small amounts of breast milk in the freezer.

According to the class action lawsuit, the lids on these Madela breast milk bottles become brittle when frozen, which can cause them to break or shatter if dropped and ruin the breast milk within. The Plaintiffs accuse Madela of failing to disclose this lid defect.

Madela denies any wrongdoing but has agreed to establish a $1.75 million class action lawsuit settlement fund to resolve the litigation.

Class Members of the Madela class action settlement include all persons in the United States who purchased at retail a 2.7 oz/80 mL, 5 oz/150 mL, or 8 oz/250 mL breast milk bottle – including any Madela retail product that includes the bottles – between July 1, 2008 and March 20, 2013. These retail products include the Madela Breastmilk Freezing & Storage Pack, the Madela Breastmilk Feeding Gift Set, the Madela Breastmilk Storage Solution, and other Madela products.

As part of the class action settlement, Class Members can receive a discount certificate valued at up to $2 for each bottle purchased during the Class Period, up to a maximum of five discount certificates per Class Member. It does not appear that proof of purchase is required to make a claim.

The only way to receive this award is to submit a valid Claim Form online at www.BreastMilkBottleSettlement.com or postmarked on or before June 20, 2013.

A Final Fairness Hearing is scheduled for September 25, 2013.

UPDATE: The class action settlement was approved on Oct. 3, 2013. Discount certificates were mailed to eligible Class Members on Jan. 23, 2014.
