More than 120 Bernie Sanders supporters have filed a class action lawsuit against the Democratic National Committee (DNC) and its chairperson Debbie Wasserman Schultz for fraud, claiming they were led to believe Wasserman Schultz and the DNC were impartial to the party’s presidential nominees.
The DNC is the formal governing body for the United States Democratic Party and is responsible for coordinating strategy in support of Democratic Party candidates for local, state, and national office.
As part of its duties, the DNC organizes the Democratic National Convention every four years to nominate and confirm a candidate for President, and establishes rules for the state caucuses and primaries that choose delegates to the convention.
According to the 121 named plaintiffs and Sanders donors, the DNC was not neutral nor impartial with respect to the Democratic primary process and was biased in favor of one candidate – Hillary Clinton – from the beginning and throughout the process.
“The DNC devoted its considerable resources to supporting Clinton above any of the other Democratic candidates. Through its public claims to being neutral and impartial, the DNC actively concealed its bias from its own donors as well as donors to the campaigns of Clinton’s rivals, including Bernie Sanders,” the 35-page complaint states.
The proposed class action lawsuit came after several DNC documents leaked from hacker “Guccifer 2.0” seemed to support the existense of collusion between the DNC and the Hillary Clinton campaign, which dated back to May 26, 2015, a month after Sanders entered the race.
As per the lawsuit, the Guccifer 2.0 documents include internal memos in which the DNC reportedly broke legally binding neutrality agreements in the Democratic primaries by allegedly strategizing to make Hillary Clinton the Democratic nominee before a single vote was cast.
Beck & Lee Trial Lawyers, a civil litigation firm based in Miami, Florida and founders of JamPac, announced the filing of the class action lawsuit against the DNC, stating anyone who donated to the DNC after Bernie Sanders entered the race for the Democratic nomination, either directly or through third-party payment platforms, along with anybody who donated to Bernie Sanders’ campaign at any stage of the primaries and caucuses, is eligible to join the class action lawsuit.
“There are essentially six legal claims we are asserting in this lawsuit on behalf of the composed class members,” said attorney Jared Beck in a YouTube video announcing the class action lawsuit. “The first is a claim for fraud—against the DNC and Debbie Wasserman Schultz—based on the revelations from the recent Guccifer 2.0 documents purportedly taken from the DNC’s own computer network.”
Claims for negligent misrepresentation, deceptive conduct, and breach of fiduciary duty were also brought in the action, specifically alleging that the DNC and Wasserman Schultz made false claims that the DNC was neutral during the Democratic primaries, when they in fact, according to the plaintiffs, favored Clinton from the beginning and failed to hold a fair election process.
Lastly, the plaintiffs bring forth claims for negligence against the DNC for not protecting donor information—as cyber criminals were able to hack into the DNC database, potentially compromising their personally identifiable information.
The proposed class action lawsuit seeks retribution of any monetary donations the DNC and a jury trial has been requested.
