Dell class action lawsuitMore than 4 million class action settlement notices are being mailed to California consumers informing them that two settlement agreements have been reached in a decade-long class action lawsuit with Dell. If you purchased one or more Optional Service Contracts covering computer hardware sold by Dell between April 8, 1999 and June 30, 2008, and paid California taxes on such service contract(s), you may be entitled to a refund of those taxes.

The Dell sales tax settlement will resolve a class action lawsuit, titled Mohan, et al. v. Dell Inc., et al., that alleges the defendants improperly charged California use tax on purchases of certain Optional Service Contracts and forwarded these taxes to the California State Board of Equalization (“SBE”).

Defendants deny the allegations, but have reached two distinct class action lawsuit settlement agreements to resolve the legal action: the Dell Settlement and the SBE Settlement.

To be eligible under the Dell Settlement, you must have purchased one of the following covered Optional Service Contracts:

  • DMLP Optional Service Contracts purchased from DMLP during the period from April 8, 1999, through September 30, 2000;
  • BancTec Optional Service Contracts purchased from DMLP during the period from April 8, 1999, through December 31, 2000; or
  • DCSLP, BancTec and QualxServ Optional Service Contracts purchased from DCSLP during the period from April 8, 1999, through February 8, 2004.

To be eligible under the SBE Settlement, you must have purchased one of the following covered Optional Service Contracts:

  • DMLP Optional Service Contracts purchased from DMLP during the period from October 1, 2000, through June 30, 2008;
  • DCSLP, BancTec and QualxServ Optional Service Contracts purchased from DCSLP during the period from February 9, 2004, through December 31, 2006;
  • BancTec Optional Service Contracts purchased from DMLP during the period from January 1, 2001, through June 30, 2008; or
  • QualxServ Optional Service Contracts purchased from DMLP during the period from January 1, 2002, through June 30, 2008.

You may be eligible to participate in both the Dell and SBE settlement.

The only way to receive a refund of the from the class action settlement is to submit a Claim Form no later than May 29, 2013.

    I bought a Dell laptop vista. It just stop working one day. I had to buy a new laptop. What they charge for service charges, I don’t remember. I know I bought the whole service package. I never use it.

    bad computer had spent over 600 dollars and got 400extred warranty ha it messed up and serviced ,then same problem gave up sent computer back to dell never heard from again very unhappy 1000 down drain

    bought 600 dell it gave trouble they sent man to my house he relaced a lot told me it needed to run new programs it took hours and did the same error 600and 400 contract worthless sent computer back to michell dell never hesard from them again

    Dell always work on your p/c and make more problems. they have charged me as high as 350.00, because my warrenty ran out. by the time you continue to keep purchasng warrentys you might as well buy another p/c. this is done purposley I’m begining to think!

    My mother bought a Dell and within 2 Mo it burned up a hard drive. We had a hard time getting Dell to send us a new computer. Then something else happened to the second one and finally we got a 3rd one and was fine. She passed away in 2010 and I have important paperwork to prove she was my mother. Her name is Lillian Simpson

    I got a dell computor I had trouble with it from day 1 I even had a 4 year warrenty on it. They kept sending me over seas.they mess up my computer so bad they gave me $100

    My husband John Hill passed away on 1-28-2003. Please make the check to me Marion Hill (wife) on behalf of Dell. I can give you a death certificate for my husband if needed.
