Plaintiff Kenneth M. filed this hip replacement lawsuit against Biomet, joining the growing multidistrict litigation over allegations that patients sustained severe hip replacement surgery complications, including metallosis (metal poisoning), as a direct result of Biomet’s defective manufacturing and marketing of the Biomet M2a-38 hip implant.

Kenneth received the Biomet hip during two separate hip replacement surgeries performed in February 2010 and March 2010. Kenneth claims that after the surgery he suffered severe pain and had to undergo complex, risky and painful premature hip revision surgeries in 2014 to remove and replace both defective M2a-38 hip replacement systems.

The Biomet hip replacement lawsuit further alleges that Biomet failed to adequately test the impact of the metal-on-metal hip replacement system or warn about the risk of hip implant metal poisoning or mention that the implant may loosen or fail within a few years after surgery.

Kenneth is seeking judgment for compensatory damages, pain and suffering, loss of earnings, medical expenses, attorney’s fees and court costs.

His Biomet Hip Replacement Lawsuit is Case No. 3:16-cv-00042-RLM-CAN, in the U.S. District Court for the Northern District of Indiana, South Bend Division.

Biomet Hip Implant Complications

The Biomet M2a-38 hip replacement system was marketed with the claim that the hip implant would last much longer than conventional hip implants and was promoted as having more advantages over other hip replacement systems.

While typical hip implants consist of four components made of a combination of metal and plastic, the Biomet M2a-38 hip has only three all-metal components: a metal femoral head, metal taper insert and metal acetabulum cup. As the metal parts rub against each other, microscopic shavings of metal may be released into the hip joint, which could cause inflammation, loosening, and other problems associated with metal poisoning from hip replacement.

Potential signs of Biomet hip replacement surgery complications could include:

  • Unexplained hip pain
  • Swelling and soft tissue damage
  • Unexplained tumors
  • Difficulty standing or walking
  • Loosening of the hip implant
  • Additional hip revision surgery
