Good news for Class Members of the Groupon voucher class action lawsuit settlement: a federal judge yesterday reversed his original decision to dismiss the settlement and has approved an amended version that no longer contains the $75,000 charity award.
We reported in October that U.S. District Judge Dana Sabraw rejected the proposed $8.5 million Groupon class action lawsuit settlement after finding fault with the cy pres award, which would have provided $75,000 to two charity organizations that had nothing to do with “righting the wrongs alleged in this case,” Sabraw said.
Shortly after the parties submitted an amended settlement agreement that dropped the cy pres award and instead added the money to the common fund for Class Members.
“The court, after reviewing and considering the objections to the settlement … overruled all objections except those relating to cy pres distribution of settlement funds,” Judge Sabraw said in his ruling Tuesday. “As the amended settlement agreement includes no cy pres distribution, the objections relating to cy pres are hereby overruled as moot.”
The Groupon voucher settlement was reached in April to resolve 17 class action lawsuits accusing the company of violating consumer protection laws by placing illegal expiration dates and other provisions on Groupon vouchers, such as the requirement that they be used in a single transaction.
Class Members are entitled to a number of benefits from the Groupon class action settlement, including a cash refund of any unredeemed vouchers they purchased that they can no longer redeem.
