Lipitor diabetes lawsuitA popular drug used to lower cholesterol levels has been the subject of mounting litigation and the case of a Nevada woman is just the latest Lipitor type-2 diabetes lawsuit to hit the courts.

Plaintiff Dorothy Watkins allegedly used the medication from 2009 until 2010 and “despite her healthy weight and diet … was diagnosed with type-2 diabetes on or about April 2010.” Her Lipitor lawsuit lawyer argues that it took until 2012 for drug maker Pfizer Inc. to add a change to the label indicating that it can lead to “increases in … fasting serum glucose levels” or in other words, elevated blood sugar.

However, the company reportedly knew of data that would indicate the possibility of women developing the chronic condition since its approval in 1996. Even now, many patients who have been diagnosed with Lipitor type-2 diabetes side effects argue that the medical jargon is inadequate and unclear.

According to studies cited in the Lipitor lawsuit, the Pfizer knew or should have known of the possibility of elevated blood sugar levels in women who took the statin as it is linked to the highest increases among the entire statin class. Had they done so, Watkins would not need to “undergo regular testing of her blood glucose levels, adhere to a restrictive diabetic diet, and take medication to her diabetes[. In addition,] she is now at markedly increased risk of heart disease, blindness, neuropathy, and kidney disease,” according to her Lipitor lawsuit lawyer.

The growing number of Lipitor lawsuits regarding the medication have skyrocketed since the warning label change in February 2012.

The Judicial Panel on Multidistrict Litigation recently consolidated these cases in U.S. District Court in South Carolina and in just a few months the number of cases jumped from about 100 to more than 500. The first Lipitor bellwether trial is set to begin in roughly a year.

The Lipitor type-2 diabetes lawsuit is Dorothy Watkins, et al. v. Pfizer Inc., Case No. 14-cv-01611, in the U.S. District Court for the Eastern District of Pennsylvania.

In general, Lipitor lawsuits are filed individually by each plaintiff and are not class actions.
