A judge has granted conditional class certification to a class action lawsuit alleging that a gynecologist at Johns Hopkins Hospital engaged in misconduct while treating patients, including photographing and videotaping patients and engaging in other boundary violations. If you were treated by Johns Hopkins Hospital gynecologist Dr. Nikita Levy, you are a certified Class Member of a class action lawsuit that is in settlement negotiations. It is estimated that close to 9,000 women could assert claims under this class action.

Who’s Eligible

Class Members include anyone who was a patient of, or treated by, Dr. Levy while he was employed by Johns Hopkins between April 26, 1988 and Feb. 8, 2013.

Potential Award

Class action settlement negotiations are ongoing. According to the Settlement Administrator:

“Establishment of this Class by the Court does not mean that any Class Member will receive any money. In the event the settlement negotiations produce a settlement, the Court will provide further notice of the settlement’s terms and any related proceedings. If the settlement negotiations do not produce a settlement, the Court will provide you a further notice regarding future proceedings and how to protect any rights you may have.”

Jane Doe No. 1, et al. v. Johns Hopkins Hospital, et al., Case No. 24-C-13-001041, in the Circuit Court for Baltimore City.

Case Summary

The class action lawsuit (Jane Doe No. 1, et al. v. Johns Hopkins Hospital, et al.) alleges that Dr. Levy secretly videotaped or photographed thousands of patients, or engaged in physical boundary violations, while treating them. Levy was found dead in his home on Feb. 19, 2013, after police began closing in on him following a tip from a patient. Hospital security searched his office the day after the tip came in and uncovered several secret recording devices, including a penlike device he wore around his neck during patient examinations. Levy allegedly killed himself two weeks after police stormed his home with search warrants and confiscated multiple data storage servers believed to have contained explicit images of his patients.

According to the class action lawsuit, Johns Hopkins failed to “discover, stop and report” Levy because its staff was not trained to recognize and report misconduct and because patients were not given the option of requesting a chaperone to be present during examinations.

On Oct. 30, 2013, a mandatory settlement class was conditionally certified in this class action lawsuit against The Johns Hopkins Hospital, Johns Hopkins Community Physicians Inc. and The Johns Hopkins Health System Corporation concerning the alleged misconduct of the deceased Dr. Levy. Although Johns Hopkins denies liability, it has agreed to enter into settlement negotiations with the plaintiffs.

Class Members must submit a registration form either online, via phone or by mail. The registration form can be found at the settlement website. There is currently no deadline to submit this form, but you must submit the form to be eligible for an award from any potential class action settlement.

    Has anyone received any updates as of 10/2016. I noticed the recording on RG/2 Claims has been updated.

      It would have been brilliant if JH had arranged Mental Health counseling and treatment for victims. Not being able to find a medicaid psychiatrist that accepts new patients has only worsened the nightmares, anxiety, and depression. Struggling alone since levy offed himself Valentine’s Eve, 2013, and no relief in sight! JH knew from past lawsuits it would drag on for years, they should have helped us by providing mental health care! This whole process has been dehumanizing and horrible. RG/2 has not earned their 25 MILLION in the slightest. Wish they would send Determination Letters already! Move it, RG/2!! Two years is too long to wait!
