Pyrex settlement overview:

Pyrex glass kitchenware maker Instant Brands LLC will pay the Federal Trade Commission (FTC) $129,416 as part of a settlement to resolve allegations it falsely advertised some of its products as being “Made in USA”, Law360 reports.

The FTC alleged Pyrex made general marketing claims that implied all of its Pyrex glass products are made in the U.S., including statements indicating the products are “Proudly Made in USA,” “American as Apple Pie” and “1 of 10 products surprisingly still made in America.”

However, the COVID-19 pandemic caused a spike in demand for baking products, including Pyrex glass measuring cups, and the company was allegedly unable to meet this demand by early 2021.

Between May 2021 and March 2022, the FTC says Pyrex shifted production of some of its measuring cups to China but continued to market them with the same Pyrex “Made in USA” claims. 

Even though the measuring cups were advertised as Pyrex “Made in USA” products, the Chinese-made measuring cups were marked with “Made in China” in red text, the FTC explained.

“In total, over a course of months and despite receiving dozens of complaints, Instant Brands fulfilled more than 110,000 Amazon.com orders of U.S.-origin measuring cup sets with Chinese-origin products,” the FTC’s Pyrex “Made in USA” lawsuit stated.

Pyrex settlement prohibits Instant Brands from making unsubstantiated Pyrex “Made in USA” claims

In addition to paying the $129,416 fine, the Pyrex settlement prohibits Instant Brands from making unqualified Pyrex “Made in USA” claims unless it can show that the final assembly or processing takes place in the United States or that nearly all of the product’s components are manufactured and sourced in the United States.

The FTC recently finalized an updated Made in USA Labeling Rule that took effect Aug. 13, 2021. This updated rule imposes civil penalties on companies that violate the “Made in USA” labeling requirements.

Instant Brands was recently hit with another Pyrex class action lawsuit that alleged the company falsely advertises some of its measuring cups as dishwasher safe even though the red measuring lines allegedly wash off easily in the dishwasher.

    I bought my set of 3 measuring cups in 1976. I bought a second set about a year later so I could have a dry and wet set. The red ink came off and that was hand washing. They never fell apart, and I can see and feel the lines for measurements. Unless I drop and break one, they will last longer than me.
