Stop & Shop Graham Cracker Ingredients Class Action Lawsuit Overview:

  • Who: A New York consumer lodged a class action lawsuit against Ahold U.S.A., Inc., the company that makes Stop & Shop band graham crackers. 
  • What: The plaintiff says that Stop & Shop graham cracker ingredients do not include enough graham flour. 
  • Where: The class action lawsuit, pending in New York federal court, was filed on behalf of consumers in that state. 

Stop & Shop graham cracker ingredients do not include enough graham flour, and consumers want more than $5 million for the alleged false advertising, a new class action lawsuit says.

New York plaintiff Idalia Valcarcel filed the class action complaint against Ahold U.S.A., Inc., on Saturday, alleging violations of state and federal consumer laws. 

Ahold U.S.A., Inc. manufactures and sells cinnamon flavored crackers purporting to be made predominantly with whole grain graham flour under its Stop & Shop brand, she says.

The product’s label reads, “Naturally Flavored Cinnamon Graham Crackers,” with images of dark hued crackers. 

“However, the ingredient list reveals ‘Enriched Wheat Flour’ is the predominant flour, indicated by its listing ahead of ‘Graham Flour,’” the graham cracker lawsuit states.

Consumers Duped by Stop & Shop Graham Cracker Ingredients

Valcarcel says consumers are deceived by the packaging to think there is more graham flour in the product than there is. She says “GRAHAM” is the biggest word on the front label and written in all capital letters, giving reasonable consumers “the impression that graham flour – a type of whole grain flour – is the primary and predominant flour ingredient used.” 

In the lawsuit, Valcarcel turns to the dictionary to make her case, saying the definition of a graham cracker is one made with graham flour. She alleges the amount of whole grain wheat flour in the product is approximately twenty-five percent of the amount of refined flour. 

As a result, the value of the product is “materially less” than its value as represented on the box. The lawsuit says the amount in controversy exceeds $5 million.

Valcarcel is looking to represent anyone in New York who bought the crackers. 

She’s suing under New York General Business Law and for breach of warranty, negligent misrepresentation, fraud, and unjust enrichment. 

The lawsuit is seeking certification of the class action, damages, an injunction, fees, costs and a jury trial.

Meanwhile, Whole Foods is facing a graham cracker ingredients class action lawsuit alleging consumers are led to believe its product is made from whole wheat and sweetened with honey, but are instead made from refined flour and sugar.
