Monsanto Roundup Cancer Lawsuit Overview:
- Who: A jury has sided with Monsanto in a lawsuit filed against it by Donetta Stephens.
- Why: Jurors disagreed with Stephens’ claims that Roundup weed killer manufactured and sold by Monsanto caused her to develop cancer.
- Where: The decision was made in California superior court.
Monsanto has been let off the hook of a California woman’s claims that the company’s Roundup weedkiller caused her to develop cancer.
A jury sided with Monsanto in determining the company was not negligent in selling its Roundup weedkiller and that it did not know it was dangerous or could be, Law360 reports.
The decision marks the second time in recent months that Monsanto has been given a favorable ruling in a complaint concerning its Roundup weed killer glyphosate ingredient.
Plaintiff Donetta Stephens claimed in her lawsuit that the company was negligent, failed to warn consumers of the dangers of Roundup and that the product contained a design defect, reports Law360.
Jurors, however, determined Roundup did not carry a risk of causing cancer that was medically accepted or that would have been scientifically known at the time it was manufactured and then sold.
Plaintiff Claimed She Developed Non-Hodgkin’s Lymphoma After Using Roundup Weedkiller
Stephens claimed in her complaint that she developed non-Hodgkin’s lymphoma in 2017 after using Roundup weedkiller, Law360 reports.
The judge overseeing the case had previously agreed with Monsanto that Stephens’ claims were preempted by the Federal Insecticide, Fungicide, and Rodenticide Act.
Monsanto got another victory in October after a jury disagreed with claims Roundup had caused a California woman’s son to develop non-Hodgkin’s lymphoma, Law360 reports.
Jurors in that case determined that the child’s exposure to Roundup weedkiller was not a “substantial factor” in his developing cancer.
Monsanto, along with its parent company Bayer AG, have faced thousands of claims that its Roundup weedkiller caused cancer.
The complaints surround the inclusion of glyphosate in Roundup weedkiller, which consumers allege is a cancer-causing chemical.
In November, the California Supreme Court upheld a verdict requiring Monsanto to pay $87 million to a California couple who argued their exposure to Roundup weedkiller caused them to develop cancer.
