Roundup Weedkiller Lawsuit Overview:
- Who: Monsanto Company is facing a wrongful death lawsuit lodged by a Louisiana woman.
- Why: Stacy Henyarnd Draten’s husband died from Non-Hodgkin’s lymphoma in 2018 after using Roundup for years. She claims Roundup’s main chemical ingredient, glyphosate, caused the cancer.
- Where: The lawsuit is pending in Louisiana district court.
A 55-year-old Louisiana man died prematurely due to prolonged exposure to the weedkiller Roundup, a new lawsuit against producer Monsanto alleges.
Stacy Henyarnd Draten says that her husband Troy Draten passed away from non-Hodgkin’s lymphoma in 2018 after using Roundup, which contains the carcinogenic herbicide glyphosate, continuously from 1975 through 2017.
“The premature death of Troy Draten, Sr. was the direct and proximate result of his exposure to Defendant’s Roundup product and subsequent Non-Hodgkin’s lymphoma,” she says in the claim.
Draten is suing Monsanto for wrongful death under the Louisiana state law, accusing the company of negligence and wrongful conduct in the making, marketing, and sale of its Roundup products.
“Roundup and/or glyphosate is defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce and lacked proper warnings and directions as to the dangers associated with its use,” the claim states.
Roundup Weedkiller Linked To Cancer By Health Agencies
Glyphosate, the main chemical ingredient in Roundup, has been found to be a probable cause of cancer by the World Health Organization (WHO) and other leading health agencies. A WHO working group concluded that the cancers most associated with glyphosate exposure are non-Hodgkin’s lymphoma and other haematopoietic cancers.
Nevertheless, Monsanto, the world’s leading producer of glyphosate, has continued to represent Roundup weedkiller as safe to humans and the environment, Draten alleges.
“Indeed, Monsanto has repeatedly proclaimed and continues to proclaim to the world, and particularly to United States consumers, that glyphosate-based herbicides, including Roundup, create no unreasonable risks to human health or to the environment.”
Monsanto has faced a slate of lawsuits from consumers who used Roundup and were later diagnosed with cancer. Earlier this month, a Georgia couple sued the company for negligent manufacturing, packaging, advertising, and selling of Roundup.
In Louisiana court, Draten is seeking damages, interest, legal fees and costs, and a jury trial in her fight against the company.
