Geico Total Loss Insurance Class Action Lawsuit Settlement Overview:

  • Who: Texas Geico customers have filed a class action lawsuit against Geico.
  • Why: The drivers allege they weren’t paid enough on their claims when their cars were deemed total losses.
  • Where: The case is being heard in a Texas federal court.

Drivers who say they were shortchanged by Geico when submitting claims for cars deemed “total losses” have been given the green light to proceed with a class action lawsuit against the insurance company. 

On Dec. 1, U.S. District Judge Judge Keith P. Ellison filed an order certifying a class action lawsuit brought by Texas policyholders against insurance giant Geico in a Texas federal court.

Plaintiff Philip Angell and four others first filed the class action complaint in March 2020, alleging all five did not receive the full “actual cash value” for their total loss vehicles. 

“Plaintiff Brown did not receive any reimbursement for sales tax, and none of the lead plaintiffs received any reimbursement for registration fees,” the order says.a

Geico May Be Forced to Pay More Than $5 Million to Drivers

The defendants are GEICO Advantage, GEICO Indemnity, Government Employees, GEICO County and GEICO Choice.

The amount in controversy is in excess of $5 million; however, it may be more as Texans lost between 300,000 and 500,000 vehicles due to Hurricane Harvey in 2017 alone, Daly & Black PC attorney Richard Daly told Law360.

GEICO had challenged whether the lead plaintiffs had standing to represent the class as the situations might not be identical. However Judge Ellison said the cases are similar enough.

In October, Geico asked a California court to approve a $19.5 million settlement with California policyholders on the same issues. The drivers claimed the insurer didn’t pay them the full amount of sales tax and regulatory fees after their cars were written off.

    I had a vehicle theft Sept. 05, 2021. I was reimbursed aprox 1200.00 after 500.00 deductible. Yet, still trying to get reimbursed for stock srereo that was also stolen and claimed with original claim. My car had been recovered with minor damages and stolen stereo. I have spoken to multiple people and am being told by my original geico rep superior, Neil, that there is nobody superior to him that I can speak with. My car is 2019 Toyoya rav 4 bought brand new. I have been with Geico approx 15 years with no late payments. Very minimal minor claims in 15 yes. Good drivers record. I am a registered nurse in Tampa, FL. I have never had any problems or difficulties such as this. I feel they are being deceptive. I’ve been told many contradicting answers and simply untruths in many occasions.

    I had 2016 Sequa, ajuster did not look at the car, and missed frame damage. After 30 days phone calls another adjuster show up and confirmed frame damage. Eventually they total car, I did not received one week car rental, body shop not received, full amount, no one payed for taxes and registration fee. My mechanic corrupted.cahnic reports that Geico is corrupted.

    I had an accident two days ago and I have had no one contacted me from Claims Department to evaluate the damages done in my car . I have tried to call multiple times but was left on hold for close to 2 hours each time. As soon as my policy ends I will be switching to a different insurance.

      Funny thing and it greatly angers me. I was in a minor fender bender on January 7, 2022 at no fault of mine. I have yet to hear from Geico and I have been put on hold for hours only to be disconnected. I will be finding another company. Terry (209)701-9112

    I had a 2010 Lexus ES 350 that was totaled by Geico. They would not pay FMV when they settled the claims. I feel that the settlement was not fair as my car had maybe 40k miles
