UPS Discrimination Class Action Lawsuit Overview: 

  • Who: Galena Goins, Sonia Lopez, and Terry A. Jones-Jackson have filed a class action lawsuit against UPS.
  • Why: The plaintiffs allege the company engages in systemic discrimination based on gender, age, and disability. 
  • Where: The class action lawsuit is pending in California federal court.

At United Parcel Services, Inc. (UPS), female employees are forced to work in the back while the men work in the front in violation of the company’s seniority rules, and women are routinely denied opportunities for advancement and higher pay, according to a new class action lawsuit.

“UPS’ standard operating procedure is to hold back women from supervisory roles, full-time and overtime opportunities, regardless of their performance,” the class action, lodged by lead plaintiffs Galena Goins, Sonia Lopez, and Terry A. Jones-Jackson, states.

Working under a double standard, women report to work at UPS unsure of their position and whether they will get bumped from their permanent positions despite their seniority, allege the plaintiffs. In this way, women are forced to prove their commitment to UPS in a way no one else is, facing demotion if they take advantage of the company’s flexible work policies or paid leave. 

The plaintiffs also say they risk isolation, being forced to work in areas with flows too heavy for one person, and are even pushed out of their section if they do not meet the new and impossibly high standards that are set for them—if they dare to complain about the unequal treatment

“UPS’ policies and practices are emblematic of the ‘old boys’ club’ that permeates corporate culture, suppresses female advancement and stereotypes women,” the lawsuit states. “When female employees complain about workplace culture, they are punished.”

UPS Class Action Lawsuit Wants Back Pay, Change in Work Policies

The plaintiffs seek to represent several Classes of UPS workers. They want the court to issue a declaratory judgment that UPS’ practices are unlawful; a permanent injunction against UPS and all persons acting in concert with it from engaging in any further unlawful practices; an order requiring UPS to initiate and implement programs that remedy the hostile work environment at UPS, ensure prompt, remedial action regarding all claims of gender, age and disability discrimination and eliminate the continuing effects of the discrimination and retaliatory practices; an order requiring UPS to initiate and implement systems for compensating female employees in a non-discriminatory manner; an order directing UPS to adjust the compensation of class members to the level that they should be enjoying; an award of back pay, front pay, lost benefits, preferential rights to jobs and other damages suffered by the plaintiffs; an award of nominal, liquidated and compensatory damages; punitive damages, litigation costs and expenses; and pre- and post-judgment interest. 

This is not the first class action UPS has faced over its employment practices. In recent years, workers lodged a class action lawsuit alleging UPS uses background checks to make employment decisions without providing the results to job applicants or employees in violation of federal law.

    I am a 60 year old woman and after 10 years and a stellar record as an account executive, I was “separated” without cause in 2021. They kept people under 40 who did not have the experience or success that I had. I made them a lot of money, but that doesn’t matter to them. I have a very clean HR record and never had any issues making my quotas. They automatically retired me without my consent and they don’t have an HR department where I can speak to anyone. I was on disability when they retired me. Can you help me with this issue?

      I am 43 years old I worked for UPS for several Years doing preload with the hopes of driving. I was prevented from driving, lied on, had comments made about my clothing how I dress got called a distraction at UPS. The union was very well aware and so was most of the building but it’s a good ok boy system they lied on me and pushed me out!

    I have worked for UPS for 6 years; due to needing a new hip, I have been on leave in limbo. Covid 19 didn’t help, neither did the Teamsters and I am out. No medical no surgery help no support no follow-up.

    I started as a driver helper, then became a permanent sorter and even though they are Union there is no support or guidance and so many times checks were not right. Grievances are a joke that just gets you screwed more.

    And I am a woman, in my late 40’s. It has been a long-I-know-nothing-haul. Other female coworkers went through worse.

    I’m a former employee, I was wrongfully fired while out on a medical leave by Dr due to injuries sustained from being physically assaulted by supervisor. I was in the Union they returned all my dues paid said I was not in the union and they made a mistake. I never cashed the check and all video of assault magically vanished considering the 27,000 cameras literally and nothing I was completely railroaded at every single turn. And security head watched it all on the videos before they deleted them. They never let me see but asked me much about the 30 min long traumatic experience. I have a phone recording of my conversation with security. HR never contacted me I had to call olive next day after being seen in ER. I need an attorney and no one In this area will assist without $250-500 consult fee. I lost my car everything because of this was diagnosed with PTDD due to being attacked from behind. I just need help please to hold them accountable for all of this and more.

    YES this happens ALL the time here in the Denver hub as well, 37 years without ever given the opportunity to advance IF you aren’t liked or don’t do “favors”

    Added me please. I’m a woman in management at UPS as an OMS . UPS’ standard operating procedure refuses to provide full time and overtime opportunities, regardless of my performance, I’ve been verbally promised opportunities that have never been provided in the last two years. I applied for this company because my grandfather worked for ups for 42 years. It’s devastating to see their gender biased behavior and refusal to provided what they promise as a world wide company
