The Fresno Grizzlies Minor League Baseball team is facing a class action lawsuit claiming its ladies’ night promotion, with its free event admission for female fans, amounted to discrimination against male and nonbinary fans.

The ladies’ night promotion for the Grizzlies’ May 25, 2023, against the Stockton Ports at Chukchansi Park in Fresno, California, allowed female fans to get in free while male and nonbinary fans were charged up to $28 for tickets, according to the baseball class action.

Most of the 2,749 fans at the ladies’ night game were male and nonbinary, and those fans saw the Grizzlies promote the alleged ladies’ night discrimination to its 71,000 followers on Facebook, 51,000 followers on X (formerly Twitter) and over 42,000 followers on Instagram.

Trio of prior rulings show ladies’ night promotions unlawful, baseball class action claims

A series of previous rulings show businesses cannot lawfully have ladies’ night promotions, the ladies’ night discrimination lawsuit says.

The prior cases “stand for the proposition that so-called ‘Ladies’ Night’ sex-based pricing promotions constitute a stated policy of unlawful gender price discrimination that is harmful to both men and women,” the baseball class action says. “Standing is not limited to those persons who actually encounter the discrimination in person but is also conferred on persons who intended to use a business’s services but were deterred from doing so because they encountered discriminatory advertisements.”

A 2019 class action lawsuit against Bass Pro Shops claimed a pair of customers were treated as “sub-humans” when the company created a “Ladies’ Day Out” promotion which prohibited men from entering into a raffle that awarded prizes only to women customers.
