Ruby Tuesday Wage & Hour Class Action Lawsuit

Ruby TuesdayA group of Ruby Tuesday bartenders and servers in New York and Florida have filed a class action lawsuit against the restaurant chain for unpaid wages, unpaid overtime and other labor law violations.

The workers claim in the class action lawsuit that they were forced to work off-the-clock and were not paid for all the actual hours they worked. This is because the restaurant allegedly only allows employees to clock-in once customers arrive, and then requires them to clock-out after the last customers leave, even though employees are required to work before and after these times. As a result, the workers claim they were not paid minimum wage for the actual hours they worked and did not receive overtime compensation for hours they worked over 40 per week.

In addition, the Ruby Tuesday workers allege in the overtime class action lawsuit they were did not receive spread-of-hours pay, or an extra hour’s wage for every shift over 10 hours. Ruby Tuesday is also accused of improperly deducting money from bartenders’ tips by illegally forcing them to use their own tips to make up for cash shortages in the tip pool allocation between bartenders and servers, food runners and hosts.

The Ruby Tuesday wage class action lawsuit is seeking compensation for unpaid wages with interest, liquidated damages, unpaid overtime, unpaid spread-of-hours, reimbursements for money taken from the bartenders’ tips, and attorneys’ fees and costs.

    Quit a year ago ! Was told to work off the clock because I would work 7 days a week and was not able to receive any over time pay. 40 hours was max. If we didn’t clock out we would get our times adjusted. Later becoming a manager for the company we were urged by our district manager to have employees do some work off the clock. For example roll silverware, sweep.

    I received a form last year for the lawsuit and mailed it in because I worked there during that period of time and was asked to work of the clock, do excessive sidework. I remember that the letter said it would be settled by this year 2014. I have heard absolutely nothing back since I mailed in that letter. A Co worker of mine has received to checks as compensation in regards to the lawsuit over the course of the last year. I would like to know who I need to contact regarding this matter.

    I worked at Ruby Tuesdays for three year and worked seven days a week. The company was rolling my time back and making me clock out to finish my work shift. They really took advantage of me and my co-workers. Everyone was scare to say anything in fear of losing our job.

    I worked for Ruby Tuesdays for 7 years. I am a victim of the clock roll back, I have seen racism at its worst with this company and so much more. I am apart of the lawsuite!!!

    I wrk for ruby tuesdays in pa an they are striate crooked. Even lied on my w2 an said i made over 9,000 dollars in tips.. where the money go i never seen it.

    I just recently started working for the company, and I think it’s a great restaurant. BUT yes it is shady as all can be. I noticed the problem with the tip out, makes me mad as hell. I worked a 9 hour shift this evening and left with $82. $28 of my total went to tip out. I would have gone home with over 100. I bust my ass for my tips. I understand tipping our host, cause they only make $3 and change an hour themselves. Our host at our location help out a lot. We have a really great team, but the way Ruby Tuesdays Corp. is taking money from us that we aren’t being allowed to keep is just ridiculous. I almost feel as though we are having to pay Ruby Tuesdays to be their employee and go along with it or we are fired. Clinton, NC
