Ruby Tuesday Wage & Hour Class Action Lawsuit

By Mike Holter

Ruby TuesdayA group of Ruby Tuesday bartenders and servers in New York and Florida have filed a class action lawsuit against the restaurant chain for unpaid wages, unpaid overtime and other labor law violations.

The workers claim in the class action lawsuit that they were forced to work off-the-clock and were not paid for all the actual hours they worked. This is because the restaurant allegedly only allows employees to clock-in once customers arrive, and then requires them to clock-out after the last customers leave, even though employees are required to work before and after these times. As a result, the workers claim they were not paid minimum wage for the actual hours they worked and did not receive overtime compensation for hours they worked over 40 per week.

In addition, the Ruby Tuesday workers allege in the overtime class action lawsuit they were did not receive spread-of-hours pay, or an extra hour’s wage for every shift over 10 hours. Ruby Tuesday is also accused of improperly deducting money from bartenders’ tips by illegally forcing them to use their own tips to make up for cash shortages in the tip pool allocation between bartenders and servers, food runners and hosts.

The Ruby Tuesday wage class action lawsuit is seeking compensation for unpaid wages with interest, liquidated damages, unpaid overtime, unpaid spread-of-hours, reimbursements for money taken from the bartenders’ tips, and attorneys’ fees and costs.

Bobbie Carter, I know about all of this too well. I also was a bartender for 5 years and went through all of the same exact things. Ruby Tuesday only cared about themselves as a company and managers tried to do whatever to make the company happy.

I was an employee for this company for over six years and use to get into verbal disagreements with management on a daily basis. I was forced to bartend because they said i was grandfathered into it. And then when they decided that we were no longer allowed to take tables which was the only way I could make state regulated min. wage I was put in a position where if I didn’t keep my mouth shut my job was threatened. When they changed the policy on bartender tip outs, by pooling them and putting it on your paycheck instead I knew that was their way of covering there base by saying well you actually do make min. wage if you account the tip pool. I would make over a hundred drinks on a Friday night and someone who makes 25 on Monday makes the same as me if they worked the same amount of hours. Also many of us would come into work at 9 or 10 am on Sunday and would be told we would have to sit there for sometimes up to 3 hours until we had a table. not allowed to clock in till then because they always had to “save labor” And what about the time after we were “cut” and had to do ridiculous cleaning tasks that could take up to 2 hours, not making tips therefore not making min. wage. Many days I worked open to close bar shifts because they had no bartenders, and I was forced to do so without a break. The list goes on and on. Now I hear they have given bartenders tables again, as a favor, well we all know thats not true. I was also asked to forced to have my time rolled back so that I could pick up money shifts because most shifts I worked were bar shifts. Many nights I worked 6 hr bar shifts and left with 10$. I was also forced to clock out to do side work so I could save my hours for money shifts. after 6 years there I have witnessed so many things. Can’t wait for my day in court!
