Dollar Tree employee lawsuit

Plaintiffs in a Dollar Tree employee lawsuit have requested approval for a $2.5 million settlement to end the suit, according to Law360. Plaintiffs allege that Dollar Tree distribution centers committed wage violations including not allowing employees proper break and rest periods. The plaintiff class includes anyone who worked at a Dollar Tree distribution center between April 2011 and the end of 2019.

Dollar Tree Employee Arbitration Agreements

According to Law360, Plaintiff Terry Snipes brought his claim against Dollar Tree Distribution Inc. in April 2015. The suit and class membership have been complicated by Dollar Tree’s employee arbitration program.

Lead plaintiff Terry Snipes opted out of this program before filing his suit. In May, U.S. District Judge Morrison England was asked by Dollar Tree to enforce arbitration measures signed by about 1,600 employees after the October 6, 2014 cutoff.

The judge forced the claims into arbitration and dismissed claims made by employees who signed arbitration pacts after the Oct. cutoff under the California Private Attorneys General Act. However, these 1,600 employees are still eligible to access the Dollar Tree employee lawsuit settlement.

The workers said in Friday’s preliminary settlement motion, “While certain of the settlement class members agreed to arbitrate their claims with defendant on an individual basis, defendant agrees, for purposes of settlement only, that the claims of such settlement class members are typical of plaintiffs’ claims.” 

The Dollar Tree Employee Lawsuit Settlement

In the Dollar Tree employee lawsuit, plaintiffs alleged that Dollar Tree’s labor and wage practices are in violation of California law. Workers allege the company failed to give appropriate breaks and maintained poor timekeeping practices.

Negotiations and significant litigation have led to a tentative settlement. The requested settlement of $2.5 million is seen as a big victory for the workers.

Dollar Tree employee lawsuitThe workers said the settlement represents “an outstanding result in light of the strengths and weaknesses in the case. In light of the significant risks involved in this matter the settlement represents an excellent result for the settlement class” in their preliminary settlement motion.

The settlement includes $125,000 to go towards claims filed under the California Private Attorneys General Act with $93,000 of that amount going to the Labor and Workforce Development Agency. Another $750,000 will go towards attorney fees, according to Law360. The roughly 2,400 class members of the settlement will receive an average of $625 each. Any uncashed settlement checks are meant to be sent to the Veterans Legal Institute.

Dollar Tree’s History of Employee Mistreatment

Good Jobs First estimates that Dollar Tree and its divisions have committed 13 wage and labor violations since 2000 resulting in fines of $65,328,128. This is by far the most costly of Dollar Tree’s violations, but employee discrimination is a close second resulting $45,218,750 in penalties for the company. The Dollar Tree employee lawsuit is only the tip of the iceberg of Dollar Tree’s alleged violations.

The U.S. Department of Labor also reports that a Dollar Tree in Pennsylvania put employees in danger by blocking emergency exits, failing to secure dangerous materials, failing to maintain sanitary bathrooms, and improperly storing and maintaining materials such as electric panels.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) found similar violations at another store in Massachusetts. All told, these two locations racked up more than $800,000 for putting employees in hazardous situations.

    I was freight, then lead, then ops manager, ending as a merch manager from 2019 to July 2022 in Washington state. I was let go because the new store manager was trying to sabotage me. Dm wanted to move her to a different store location, with a pay raise, and I was going to start sm training to run that location. She didn’t want to leave that store, so she would do little things to try and make it so I was late like change the lock without giving me the new combo, and scheduling my freight crew an hour before me and reporting it to corporate without me signing a write up. I documented EVERYTHING and was approved for unemployment I was wrongfully terminated, but not at all upset about it anymore. Most dollar tree stores are shady in the working environment and cutthroat in the management area. And yea at one of the stores I worked at the sm would edit the time sheets so the store wouldn’t go over allotted hours given. If someone went over 40 hours, she would get them to be content with carrying them over to the next week so dt didn’t have to pay overtime SMH. .. Shady AF

    Doing Trucks For Months…We Were an XL Store…We Had4 Managers and 5cashiers…Should Of Been Running 4 registers. TALK ABOUT PROBLEMS HOW DO YOU MAKE A SCHEDULE WITH 5 CASHIERS. I JUST COULDNT MENTALLY OR PHYSICALLY DO 1 MORE DAY…I FINISHED TRUCK TOLD STORE MANAGER. I AM DONE..Of COURSE NO UNEMPLOYMENT WOULD BE RECIEVED…IT SUCKS

    I worked there 2019 and worked off the clock all the time because of we didn’t have enough hours for everybody and lie about taking breaks they wouldn’t let us take breaks it was horrible working for Dollar tree I need in on this

      Seriously? I quit $ tree right bfore Xmas 2021. And ya they never had any extra hours to give but they got me F’d up if they think they’re going to give me 15hrs a week and then try and make me work off the clock or with no break. Ya’ll need to remember (especially during covid) they are hurting for employees BAD right now. The workers have the advantage right now cuz nobody wants to work now, especially at $ tree for min wage, trust me they will not risk u quitting over a break. My GM was begging me to stay. And while I was a decent employee… I definitely shoulda been fired multiple times for taking xanax and nodding out while being cashier lol. So if I didn’t get fired I’m sure ur good. And even the DM knew

    I filled out a claim and never heard anything back about it, I feel like this is just like the company don’t care about people. I worked from 2010 to 2016 started partime cashier worked up to store manager and traveled with the company while always working more hours then pay . I’m sure nothing will come of this in Alabama

      Me too I work from 2013 to 2016 North Hollywood Sherman Way and I would work also off clock especially in holidays where the lines will get long and I think they were even sued before and they continue to do the same thing what they would do is an hour or two before we would leave they would make us clock out …one time it was Valentine’s Day and we stood until 1am but we clocked out earlier at 9 p.m. the line were so long that we didn’t even get a break I feel bad for the assistant manager as well because we were short and staff and they would make them do basically everything

    I’m in texas! Same ole scenarios as all of you! My DM is the worst ever, trying to get in touch with RM is impossible or even the speak up line for that matter! Guess they don’t wanna have to pay the measly $1000 ? All of my time here has been a joke! I have endless amounts of evidence and even pictures with time stamps of each of the occurrences! Even the emails and texts I sent trying to demand help and almost a year and a half later still dealing with the same issues! I know it would of been easier had I found another job by now but I live in a small town, during the pandemic it was really hard to find anything else but I love my job and customers and even my employees but it’s hard to keep people when we’re paying minimum wage and working them like slaves!

    Am Okechukwu Uwaegbu, i applied as sales associates & was hiried at dollar tree 14100 Baltimore ave suit 103 laurel 20707 MD on 3/5/21 and was started my duty on 3/7/21 as sale/cashier but was reposted on 3/8/21 to another branch dollar tree at Fort meade road laurel as night Stocking Postion which i worked only 5 hours on that very day, the night store manager told me that she gonna contact me but since then till now i have’nt had from her, but told me that there store don’t have my data record as well as i went back to the first store i was hiried & have already started working, to lay my complaint also to restate me back inwhich the store manager also told me that i dose not anymore belong in very store even the have’nt pay my two days work paycheck i worked with them. I have been reporting my case to those store managers yet not getting any good answer. Please help me out

    I was a assistant store manager for 5 years and I had to come in off the clock unload trucks stock do inventory checks I mean hours and hours of unpaid time have went in at 5 am and worked till 12 am because I wasn’t given enough hours to stock and get my trucks out and really do anything the other store manager would go in and change the schedule on me and cut my hours purposely and finally after being borderline with a nervous breakdown I had to walk away it just wasn’t worth it anymore but I should be paid thousands but will never see it in sure

    How do I get on on this lawsuit? I was a store manager in training in Tulsa Oklahoma. As an assistant manager I would go to the bank at night by myself. And I never got a real lunch after the first 9 months with the company because I was made an Assistant Manager. I worked off the clock almost every day. I was hurt on the job and when I left the company they stopped ally medical. I am in need of a second surgery for the accident that happened in my store. I was forced out of the company by a DM in Springfield MO. That company is not a fair practicing company at all. They are for themselves and screw anyone that makes a complaint.

      I filled out a survey for the lawsuit and never heard back from them. I worked with them for 2 years and had to clock out for a hour every shift even tho I couldn’t leave and most times my food got cold because I was dealing with customers during that hour since I was the only manager on duty from 2pm until close.
