wage and hour overtime healthcare workersA former employee of John Muir Health recently filed a class action lawsuit over alleged California labor violations, including failure to pay proper overtime wages.

The lead plaintiff, Karen M., worked for John Muir Health in California between May 1, 1997 and Feb. 19, 2016, a total of 19 years.

According to Karen’s lawsuit, she regularly worked overtime hours–over 8 hours in one workday and over 40 hours in a workweek. In the fall of 2013, the lawsuit alleges, John Muir Health made a cost-cutting policy change that resulted in requiring employees like Karen to work off the clock in order to complete their tasks. However, these employees were not compensated for this work, she claims.

The loss in wages was apparently substantial. Karen alleges that she was required to work off the clock around 300 hours total. Under proper overtime payment regulations, she would be owed around $30,000 in unpaid wages, the lawsuit claims.

These overtime wage claims were not the only California labor violations claimed in the lawsuit. On top of this uncompensated off the clock work, Karen and other employees were allegedly denied proper meal and rest breaks.

Karen filed her California labor violations class action lawsuit on Oct. 6 in the U.S. District Court for the Northern District of California. The lawsuit was filed on multiple counts, including failure to pay wages for all hours worked, failed to pay overtime, failure to pay minimum wages, meal and rest period violations, and failure to provide accurate wage statements, among others.

It can be helpful for California employees to understand the major facets of California overtime laws to be able to recognize California labor violations, such as failure to follow overtime regulations. Being familiar with the law can help workers know when to seek subsequent compensation for their work.

Some employees may be nervous when speaking up about violations of California overtime laws. There are laws in place to protect workers from retaliation.

In California, there are penalties for failure to meet wage and hour laws, such as underpayment or unpaid wages, paying wages with insufficient funds, failure to provide meal or rest breaks, failure to provide one day’s rest in seven, failure to pay wages timely upon termination, and unlawful deduction of wages.
