The State of Survival app falsely advertises price discounts for in-game purchases, according to a recently filed class action lawsuit.
Plaintiffs Angela Prado, Staci Turner and Kimberly Surette filed the State of Survival class action lawsuit against Funplus International AG and Kingsgroup Holdings on Sept. 2 in California federal court.
State of Survival is one of the highest-grossing mobile strategy games on Android and Apple devices with an estimated revenue of more than $80 million each month, the plaintiffs say.
State of Survival class action says in-game purchases never offered at non-discounted price
Since it was launched in 2019, State of Survival has generated more than $1 billion in revenue by offering “microtransactions” for in-game purchases that are needed to level up in the game, the State of Survival class action lawsuit explains.
The in-game purchases are reportedly priced from 99 cents to $99.99 each.
“However, in its direct marketing to consumers (including representations made at the time of purchase), FunPlus advertises false former prices to induce players into believing they must act quickly to take advantage of a limited-time sale price,” the State of Survival class action lawsuit states.
The plaintiffs argue that FunPlus dupes customers by offering “bonuses” for a limited time that lead the app users to believe they benefit from limited-time promotions. The app shows strikethrough pricing and percentages to mislead consumers into thinking they are getting a discount when in reality the referenced prices are fabricated.
“These advertisements have run for years,” the State of Survival class action lawsuit states. “But at no point, let alone within three months of the advertised discounts, have these in-game items ever actually been offered at a non-discounted price–i.e. without their “limited time discounts.”
These types of false pricing schemes are prohibited under California law, the plaintiffs claim.
They argue that the defendants fraudulently concealed the truth about their advertised discounts and former pricing in violation of California law. They claim that they would not have paid for the discounted in-app purchases if they had known they were based on fictitious original prices.
In related app news, the seller of popular “free” video games Clash of Clans, Clash Royale and Brawl Stars was recently hit with a class action lawsuit over the sale of in-game currency to minors.

I’m at 91,000. I started playing because I have no real life social interaction. I’ve known they’d played on people’s weakness with manipulation and lies. Just thought it was lost money. Please count me in! Anything back and to banned from this game would be a blessing for me.

Add me, I have made purchases under flash pretences for exactly those reasons, state of survival is unwinnable, it’s the same as the grand mafia same false deal sales makong you believe that if you don’t buy it now you’ll be beat and have to pay 4 times as much and it doesn’t change the price if you don’t by it doesn’t expire

Add me since the DEVELOPERS behind SOS get even worse as you progress into the game and their % are NEVER even close to what they show. They have hit a billion dollars in revenue and I am glad that this is finally happening
