Qunol extra strength magnesium class action lawsuit overview:

Qunol Minerals formulates, manufactures, advertises, and sells magnesium dietary supplement capsules that are falsely advertised as being “Extra Strength,” a new class action lawsuit alleges. 

Plaintiffs Dalit Cohen and Rosemary Robertson claim Qunol advertises that two magnesium capsules contain an “impossible” 420 mg of magnesium glycinate. 

Cohen and Robertson argue magnesium glycinate used by Qunol “simply possesses far too low a concentration of magnesium” to be able to fit 420 mg of it into two of the sized capsules the company uses. 

“The Magnesium Supplements do not contain 420 mg of magnesium as magnesium glycinate in a 2-capsule serving and thus do not contain the quantity of magnesium that is advertised,” the Qunol class action states. 

Cohen and Robertson want to represent a nationwide class and California and New York subclasses of consumers who have purchased Qunol’s ‘Extra Strength” magnesium dietary supplement within the last four years. 

Qunol skirts federal laws and regulations by allegedly misstating amount of magnesium capsules contain, says class action

Qunol skirts federal laws and regulations “designed to prevent deceptive supplement labeling and breaches the express warranty created by its labeling” by allegedly misstating the amount of magnesium the capsules contain, the Qunol class action alleges. 

“Defendant’s prominent misrepresentations regarding its Magnesium Supplements form a pattern of unlawful and unfair business practices that visits harm on the consuming public,” the Qunol class action states. 

Cohen and Robertson claim Qunol is guilty of fraudulent concealment and in violation of the New Jersey Consumer Fraud Act, New York General Business Law, and California’s Consumers Legal Remedies Act, among other things. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with an award of actual, incidental, consequential, punitive, and statutory damages for themselves and all class members. 

A number of class action lawsuits were filed against over-the-counter supplement and medication manufacturers and sellers last year over claims they falsely advertised the products in some way.
