Plaintiff Catherine Hosino allegedly experienced this issue in June 2018 when Sprint debited her account for an automated recurring withdrawal of $1,3989.94. Hosino says she had insufficient funds for this massive charge.

Hosino claims that she was not a Sprint customer when the company debited her account and she had no reason to believe she owed any sort of outstanding balance on her Sprint account that was closed in November 2017.

“Based on banking records, it appears that Sprint had Plaintiff’s debit card information on file, and without written authorization, decided to attempt to automatically withdraw the entire balance through an EFT request with her banking institution without notice or authorization, written or otherwise,” the Sprint class action lawsuit claims.

Due to this unexpected transaction, Hosino submitted a fraud dispute with her bank and her account was frozen while the bank looked into the issue. The plaintiff disputes Sprint’s claims that she owes them money.

In her Sprint class action, Hosino argues that Sprint likely initiates similar transactions with other consumers despite not having consumer authorization.

“Such conduct is inherently deceptive in that it misrepresents to consumers the right to stop automatic withdrawals and results in Defendant continuing to automatically withdraw, and to potentially overdraft, Plaintiff and the Class’s accounts,” the Sprint class action lawsuit claims.

The Sprint class action lawsuit alleges that the cellular provider violates the federal Electronic Funds Transfer Act (EFTA) by failing to acquire consumer consent before making transfers.

The EFTA was passed in 1978 to adjust to the growing prevalence of electronic banking and ATM usage. The act aimed to provide banking customers with the same amount of confidence that they had with paper checks by requiring a notice of fees, clear disclosures, and clear authorizations of transactions.

In terms of authorizing transactions, the EFTA requires that a “preauthorized electronic fund transfer from a consumer’s account may be authorized by the consumer only in writing, and a copy of such authorization shall be provided to the consumer when made.” Sprint allegedly fails to comply with this requirement by failing to get a consumer’s written authorization to debit their account.

Hosino seeks to represent a Class of individuals for whom, within the past year, Sprint initiated recurring electronic funds transfers from a debit card account or bank account number without first providing a copy of written authorization. She estimates that there are at least hundreds of individuals included in the proposed Class.

The Sprint class action lawsuit seeks actual damages or statutory damages (whichever is greater), punitive damages, injunctive relief, interest, court costs, and attorneys’ fees.

    Please add me to your list. I live in phoenix, Arizona in December they cleaned out my bank account 2 days before Christmas. I have had nothing but problems with this company for the last 2 years.

    Sprint continued to bill my credit card for service on one phone number after I had cancelled service on that one line in October 2018. Until I had closed all 5 lines of service in January 2019 and was still being billed for the first line closed did I realize they had not closed service to that first line. I disputed the charges with Sprint which refused to refund and continued to bill monthly. VISA investigated and returned to me their estimate of the overcharges. Sprint has now sent the bills to several collection agencies, affecting my credit rating. I then have to dispute those and each unique dispute (3 so far that I recall) has returned my credit rating to Excellent. But now Sprint is claiming that I claimed someone took my identity and asked for paperwork, including a police report. Naturally, I don’t have any such thing since I’ve never had my identity stolen. Sprint is simply intimidating me. I’ll happily join the class action suit. I have several letters sent to Sprint and/or their collection agency. I have requested in all my contacts with Sprint asking for copies of their records of my account. Needless to say, they have never supplied anything. However, on one call with their representative, they told me it was clear that the account had been canceled.

      They are doing the same to me. I ended services and transfered my number to Verizon and sprint is still billing me for 2 months after the fact. This is rediculous. Need class action suit because they are now hurting my credit. Im not paying it

    They did the same thing to my “account”. In November of 2019 I left them after having to pay in excess of $200 a month for 2 LINES! When I left my daughter was present as I paid off EVERYTHING. I paid off our phones…I paid off any remaining balances as well as asking them if there was any that might be owing in the future. The representative told us that we had ABSOLUTELY paid off everything. I then went right to T-Mobile to sign up with them. After having to spend another couple of HOURS on the phone with Sprint (while inside the T-Mobile center) telling them to transfer my numbers over to T-Mobile…I was finally DONE with them. Or so I thought. The very next month they withdrew over $200 from my account AGAIN! After spending HOURS again on the phone with various “customer service” reps…I was finally talking to a supposed “manager”. After another HOUR on the phone with him he tried to pass the charge off as a remaining bill that was owning. EVEN THOUGH I had already cleared explicitly with the in store rep that I had PAID EVERYTHING! Anyway, I finally just said…or rather screamed…DON’T CHARGE ME EVER AGAIN! I told him I was done with them forever. Then the next month they took another $60+ out of my account. FURIOUS I called them again. This time they tried to tell me that I had an “extra” line that I hadn’t closed when I left them for T-Mobile. WHY IN THE HELL would I leave them for another telecom company and leave some random “extra” line open with them for a phone that I didn’t even own! So…after another some HOURS on the phone with ANOTHER idiotic “manager”…I again screamed at him to CLOSE THE GODDAMN LINE! I told them again that I WAS DONE WITH THEM and that they had better not try to hit my account again because I was closing it. I then went to the bank and filed a disputed transaction with them. Closed the one card that Sprint was using to steal money from me. Opened up another card and transferred all my other accounts over to it. Sprint tried to debit even more money from me but couldn’t because the account was closed. Now they are claiming I owe them over $300 and they have sent it off to some crooked collection company in Vegas (of course). So, now my credit report is in the crapper because they have some sort of collection action against me. OF COURSE I want to join this class action suit. PLEASE put my name on it. Email me if you need to. I would be happy to testify against these crooks!

    I canceled my account several times starting in August 2020, here I am on the phone again with them at the end of November because they are trying to take more money out of my account after 2 previous times of them taking money unauthorized.

      Me too I have to fight with them every month to make corrections to Bill they say they fix it and don’t now I signed up for 189 a month in services and equipment that goes up and up to 266 and they use AUTO PAY credits as a means to access accounts and take far more than expected they are THEIVES now i am going to lose my service I cant pay 266 a month or even 200 and they keep taking whatever they
      They want .now I’m in a motel for covid and no PHONE HELP

      I have been over charged for a table and even when it was paid off they were still charging me for it so I called and complain but they didn’t want to listen to me so now I need you to please help me with this problem I want my money back that they owe me but they said they will not give me my money back

    I was overcharged $263.19 by adding safe and found and lookout premium subscription without my authorization. I chat with them, they only gave me $59 credit back. I have more issues with sprint. please add me to class action and would like to talk to a lawyer regarding more details.

    I would like to be added to this lawsuit. I returned 5 leased phones and purchased new ones from Apple. They have continued to charge me for all 5 phones, over $2000. They were returned on the end date of the lease. They said they never got them so they charged us month to month without us knowing. So horribly rude when we were trying to resolve it.

      They charged me for an iPad that was supposed to be free as an apology for adding random charges on and off over the course of a year. Then, without consent, charged me for the tablet and set up service and a line for it. I specifically told them I didn’t want service because I had WiFi and a cellular hotspot. They did it anyway, and after I cancelled my account they reported to the credit bureaus that I owe them almost $800, screwing up my credit that I have been working so hard to bring back up after the birth of my son so we can buy a house. ? These guys are such scamming frauds. Please add me to the lawsuit.
