LG-v10-smartphoneLG has been hit with a proposed class action lawsuit alleging its V10 smartphones contain a bootlooping defect and the company fails to honor customers’ warranties.

Plaintiff Oscar Herrera says he purchased a LG V10 smartphone for $672 from a Verizon store in San Luis Obispo, Calif. He also bought a phone cover and glass screen protector for his new phone.

However, shortly after the one year warranty on his phone expired, Herrera experienced the bootloop problem, which rendered his V10 smartphone completely useless.

Herrera brought his phone to LG for repair, but was allegedly told that his phone was not eligible for coverage because the warranty had expired.

According to the LG V10 smartphone class action lawsuit, the bootloop defect often arises without warning, and puts the phone into a “death-spiral” where it will suddenly switch off and then remain stuck on LG’s “Life’s Good” screen. When this occurs, the phone is completely unresponsive and non-functional.

Reportedly, the problem originates from a hardware defect that causes the phone to overheat. Herrera points to numerous complaints posted on product reviews, blogs, and other consumer resources revealing that LG V10 smartphone users have experienced similar bootlooping problems.

The lawsuit also states that when consumers have replaced their phone under warranty, many have had to wait several days or weeks to receive an accommodation – which often ends up being a new V10 smartphone that suffers from the same defective design.

Some consumers have also reported losing photos and data that was stored on the bootlooped phone, the lawsuit states. Herrera also say that customers have been denied warranty coverage under the pretense that the screen is scratched.

Herrera claims that LG was aware or should have been aware of the V10 smartphone bootloop defect, but failed to disclose this to consumers. What’s worse, is that LG routinely refused to provide repairs free of charge for consumers who experience the V10 smartphone bootloop defect shortly after their warranties expire, the lawsuit states.

As a result of the V10 smartphone bootloop defect and LG’s alleged inadequate response to consumers’ complaints, the lawsuit contends, consumers have suffered injury in fact, incurred damages, and have been harmed by LG’s conduct.

Herrera is bringing the class action lawsuit against LG for violations of state and federal warranty laws. He is seeking recovery for monetary and equitable relief for LG’s alleged failure to implement or honor the terms of its warranty, breaches of implied warranties, unjust enrichment and declaratory relief.

The plaintiffs seeks to represent a certified Class of “all persons or entities who (a) currently  own a LG V10 Phone and/or (b) previously owned an LG V10 Phone, and can be identified as having incurred out-of-pockets expenses related to the bootloop defect.”

Herrera and the proposed Class are represented by Brian S. Kabateck, Drew R. Ferrandini, Lina B. Melidonian of Kabateck Brown Kellner LLP; Brian D. Chase and Jerusalem F. Beligan of Bisnar Chase LLP; and Benjamin F. Johns, Andrew W. Ferich, and Jessica Titler of Chimicles & Tikellis LLP.

    Would like to join this CAL, as my phone has done it and now my wife’s phone is doing it. Seems like there is no resolve without having to pay extra charges to fix a phone that they are aware of issues.

    Same thing happened to my G4 so i upgraded to a v10. New phone same problem. I was told that the problem was not with the phone itself but that it was a problem with my charger. I use the charger tha comes with the phone so i do not see how this could have been the problem. This is my only way to communicate. I am an area supervisor for 8 mobile home parks. My phone is my job. Without it i will have no job. I lost all of my photos , passwords for work that were very important. Text messages that i needed for court proceeding on tenants cases. This is ridiculous. Why are these phones still being sold and if they know what the problem is , WHY DONT THEY JUST FIX IT? I would like to please be included in this lawsuit .

    Same thing happened to mine the other day and it is out of warranty.
    Verizon won’t do anything, no extra insurance on it. Very upset, had phone for 1 year and 4 months. I need to sign up for this lawsuit as this phone was not cheap. Loss of photos, videos etc.

    My wife and I both have v10s. Hers bootlooped within the first year and AT&T warranty swapped it for another v10. My phone got stuck in the loop a month after the 1 year warranty and both AT&T and LG refused to do anything for me. We’re still paying for phones we can’t use. Can’t upgrade yet, AMD can’t afford a new phone either. I’d really like to join the CAL. This isn’t right at all

    Same thing happened to mine the other day and it is out of warranty, used to be my favorite phone. first one died and at&t sent me a new replacement and somehow that new or refurbished one they sent me didn’t come with any warranty…

    V10 went down today. Will show Verizon screen and shut back off. Was burned by it overheating and Verizon won’t do anything, no extra insurance on it. Very upset, had phone less than 2 years. I need to sign up for this lawsuit as this phone was not cheap. Loss of photos, etc.

    Wow, just ran into the EXACT same thing with my V10 and received the EXACT response as covered in the article. Verizon Wireless happily told me to send it in since it was under warranty and they would send me a choke choke refurbed V10 which they did. Five days later I was hit with a $300.00 damaged device fee with them claiming the screen was cracked which it was not when I sent it back to them. All of this and I have insurance on the phone. After 4 conversations with Verizon wireless, I was put in touch with presumably their best CCD rep. In the end, she was able to get me $175.00 credit against the $300.00 but they should have been paying me for the inconvenience. For the record, the refurb replacement gets hot and shuts down apps for no apparent reason. Very unhappy with both LG and Verizon in the handling of this matter. Where do I sign up for the CAL?

    I had this happen as well. I was 2 weeks out of warranty. The guys at the AT&T store weren’t going to do anything to help whatsoever. I called AT&T and eventually I found their best customer service rep ever as I was considering never doing business with the carrier again nor LG. She honored the warranty for me, but my phone was replaced by another v10 which gets very hot. I would also like to join into this lawsuit against LG as the phone is every expensive and I lost personal photos and files as well.
