person removing mattress coverA class action lawsuit has been filed against mattress company Zinus, with plaintiffs claiming the mattress can open and release hazardous glass fibers.

Plaintiffs Amanda Chandler and Robert Durham say that once the outer cover of the said mattresses are unzipped, large glass fibers can spill out, causing serious injuries and property damage.

The Zinus class action lawsuit states that on Feb. 14 2020, a news piece entitled “Hidden Hazards” aired on a CBS affiliate in St. Louis documenting “the danger lurking in your mattress.” The news story outlined the plaintiffs’ experience in this case when the Zinus mattress released a large amount of glass fibers, causing life-threatening injuries to their family.

Chandler claims she purchased the Zinus mattress from a Walmart in the summer of 2019. She alleges the mattress contained a removable outer cover with a zipper. In addition, she states that there was a tag on the outer cover which read, “62% Glass Fibers.”

The mattress tag did not inform the customer that the outer cover should not be removed, nor that the removal of the outer cover would cause the exposure of the contents of the mattress, namely the glass fibers, the Zinus class action lawsuit claims.

On Jan 20. 2020, Chandler says she removed the outer cover of her mattress in order to clean it in her washing machine. While she was washing the mattress, her sons were having fun jumping on the mattress, she alleges.

The next day, Durham, Chandler’s husband reportedly noticed that his skin was very itchy and irritated. At some point, he discovered that his entire body was covered with small, hard to see glass fibers, the plaintiffs argue.

The plaintiffs claim they noticed that their entire home was filled with the little glass pieces. They state that “tiny shards of glass were embedded in all parts of their home, both inside and out, including their clothes, bedding, towels, appliances, carpet, tile, walls, tools, electronics, and inside their cars.”

man on bed holding back and grimacingThe release of the glass fibers caused all of the family members to have dermatitis and Durham has had several shards of glass fiber removed from the back of his neck, the plaintiffs claim. 

In addition, the severity of the family’s injuries are unknown, as they could have inhaled a significant amount of glass fibers, the plaintiffs say.

After discovering that the source of the fibers was the mattress, Chandler immediately removed the mattress inside their home to the outdoors, the plaintiffs aver.

The family is now living in a hotel as they are unable to return to their home due to the fiberglass contamination, notes the Zunis class action lawsuit. 

The plaintiffs allege that the glass shards contained in the mattresses are for fire retardant purposes and are larger than the type of fiberglass than is used in household insulation.

The plaintiffs also state that, “exposure to glass fibers may cause eye, skin, and upper respiratory tract irritation. Glass fibers that reach the lower part of a person’s lungs increases the chances of adverse health effects. Glass fibers that become embedded in human skin may require surgical intervention for removal.”

The cost of cleaning a house which was exposed to glass fibers can cost tens of thousands of dollars and experts may advise that the residents leave the house until it can be professionally cleaned, the plaintiffs argue.

The defendants in this class action lawsuit allegedly knew about the dangers of taking off the outer cover of the mattress as they responded to a message board posting that removing the mattress cover could jeopardize the systems within the mattress, according to the plaintiffs.

The Zinus class action claims that nowhere on the warning does the company mention words such as fiberglass, glass fibers, or that the mattress contains glass. In addition, the warning does not state that removing the outer cover can cause the mattress content to be released into the environment, causing significant injuries to the customers, the plaintiffs maintain.

The family argues that they wouldn’t have purchased the mattress, or would have paid less for the item, had the design defects been known to them.

The defendants have violated the Magnuson-Moss Warranty Act and are guilty of fraudulent concealment/fraudulent omission, and unjust enrichment, claims the Zinus class action lawsuit.

Potential Class Members include: “All persons who purchased an Affected Mattress in the United States, which was manufactured by Zinus and contained glass fibers.”

    Purchased several of these for my children. Pulled the zippered part off to wash it and had fiberglass everywhere. In washer on all our clothes. I couldn’t wrap my head around what it was bc i thought can’t be possible but oh boy. We have had ongoing issues for over a year and this is the first time I’m hearing of this. Just disgusted at this company. My daughter has been in and out of ER bc she can’t breathe and now I think I know what’s the culprit. This stuff was floating everywhere. You have got to be kidding me that a company could be this irresponsible to its consumers. This company deserves to be held accountable. Not one place did it say that cover was not washable.

      Mi esposo y yo compramos 2 colchones y nos hemos percatado de que en los muebles de nuestra recámara se ve la fibra de vidrio como brilla con la luz como si fuera polvo pero se ve claramente son astillas muy delgadas y chicas por toda la habiatacion, ambos sentimos irritación en los ojos desde hace tiempo y pensábamos que el detergente que usábamos era lo que nos irritaba la piel, y ahora entendemos que es el colchón el que está ocasionándonos estos problemas. Estamos muy disgustados por que nuestra Salud se ha visto afectada y ahora tenemos que hacer el gasto de comprar nuevos colchones y limpiar a profundidad nuestra casa para que no se esparza más esa fibra de vidrio.

        Hola estoy pasando por lo mismo el día de ayer lavamos el cober. Del colchón que tiene cremallera y al acostarnos nuevamente vimos todas las partículas de vidrio una comezón inexplicable y me está doliendo el oído como hago para ser parte de esta demanda

    I bought my Zinus mattress about 3 years ago. My daughter was fine before I bought this mattress. Now that I am covered in shards of fiberglass and see what devastating effects fiberglass has on the respiratory system, I believe this bed gave my daughter the breathing problems she so severely had. She had to have surgery for her enlarged and irritated adenoids. And recently I go to wash the cover that came with the bed that has a ZIPPER !!! And no signage to not take it off, and now I’m In so much pain. Can’t sleep. Apartment infested with fiberglass everywhere! Please help!

    I purchased ny zinus 10 in matress for my son and a year after that he started having respiratory problems. The Dr’s said he had bronchitis, then asthma and it was just asthma flare ups and my poor baby has been sleeping on a toxic bed I didn’t even know has been injuring him all these years. I been in and out of the dr office every month. I just found out this matress is what is causing him to be sick every 2 weeks and missing school. I just bought him a new matress and made sure to read what it was made of. Everyone who owns this brand needs to know they are at risk of this harmful matress. I would like more information in regards to how to file a claim please and thank you and prayers that all of us get better and the help that is needed to get these toxic mattresses out of everyone’s home

    Have had this mattress for 3 years, I put a thick waterproof cover when we first bought it. Summer of 2022 I washed the cover I added, and got a rash on my hands and arms, and my torso that I couldn’t explain. I added another topper to our bed, thinking perhaps the memory foam was too hot, and needed more barrier between my body and the mattress. December ‘22 I had a miscarriage, my mom removed the covers (the two I personally added to this mattress, never removed the original) to wash them to clean up from the mess of everything, I get back into the freshly made bed to rest… my whole torso, arms, face, neck, chest is covered in this painful, itchy, burning rash. I decided to look into this mattress (Zinus green tea memory foam plus cooling gel) and see all of this information about fiberglass dermatitis!? What!? I’m miserable, it’s been a whole two months of discomfort and no relief. This mattress leaked fibers without the cover ever being removed.

    So I have had my Zinus mattress for about 5 years now. Today (literally an about an hour ago) I decided to take the mattress cover off and wash it. As I was taking it off I noticed shiny like threads and it made me wonder what it was. I put the mattress cover in the washer then dryer and finally brought it back to the mattress to put it back on. As it was washing I kept thinking that all of a sudden it felt like something was cutting me. It’s dark so I use my flashlight on my phone to examine myself and see that I have sparkly shiny spots ALL OVER MY BODY and FACE. IM SCARED RIGHT NOW BECAUSE I DONT KNOW HOW MUCH OF A HAZARD THIS IS FOR ME OR MY NEWBORN. But please help and respond to this because at this point I’m afraid for myself and for my babies. I don’t know what to do about this or how to go about removing it from my body and the rest of my bedroom.

        I am going through the same thing right now. Just washed my cover today and there are fibers everywhere. I’m going crazy trying to get rid of them, and I just keep finding them on new surfaces. Very worried I will have the symptoms others are listing.

    I purchased a Zinus 12 inch gel infused mattress in June 2, 2021. I have noticed respiratory problems about a year ago. I have since bought a new mattress as of today and stay at a friends house and do not sleep on this mattress anymore as it is still in my apartment.

    I purchased a Zinus mattress in 2016. I began coughing that year and am still coughing to this day. My lungs are constantly “itchy” and burning. I sometimes have troubles breathing. In 2020 I had Covid and had to be hospitalized. I am wondering if this made my case worse as it was coexisting with the virus. I went to a pulmonologist and he was unable to find anything that would be causing the coughing and eventually told me I have asthma. I never knew about the exposure to the Zinus fiberglass. Along with the coughing, I too have experienced the tiny itchy bumps on my body that I could never figure out. I also experience severe eye itching and burning. It comes on out of the blue and feels gritty under my eyelids. I believe I’ve finally found the reason for all of these unexplained symptoms.

    I have two Zinus tea mattresses. My son who is disabled and already has lots of medical problems has recently (6 months after purchase) complaining of red eyes, itchy eyes. Has been waking up completely stuffed up, recently been waking up saying having hard time sleeping cuz something makes his breathing heavier he calls it. Been to many Doctors none have been able yet to find the answer. I have one also. So are we supposed to wait until we’re really sick before we can return the mattress for a refund. I just got mine 3 months ago before I started reading all the problems.

    I am now also suffering the consequences of owning one of these Zinus mattresses and it is WREAKING HAVOC in our home with us and our 4 pets, rendering everything we own contaminated garbage. I don’t know where to start or what to do, we cannot afford to even refurnish our home let alone pay the $7,500 quote to clean this mess.
