Wayfair warranties class action lawsuit overview:

Wayfair violates federal anti-tying law by stating that warranties for their furniture products will be voided if a consumer uses a third-party repair service to fix them, a new class action lawsuit alleges.
Plaintiff Annamarie Galante claims Wayfair wants to prevent customers from using third-party repair services to “maintain a monopoly on repairing the goods they sell.”
Wayfair also wants to maintain a monopoly on the sale of after-market parts, according to Galante, who argues consumers won’t attempt “even simple, inexpensive repairs” in fear of voiding warranties.
The anti-tying rule was put in place to promote a competitive marketplace for repair services by guaranteeing consumers “the right to obtain repairs from service providers other than Defendants,” according to the Wayfair class action.
“Beyond unlawfully proscribing customers’ federal consumer protection rights, Defendants’ conduct further harms consumers by stifling the third-party repair industry,” states the Wayfair class action.
Wayfair accused of ‘stifling’ competition in third-party repair industry
Galante wants to represent a Pennsylvania class of consumers who have purchased a product that is subject to Wayfair’s warranty.
By allegedly “stifling” the competition in the third-party repair industry, Wayfair “drives up the cost of repair and limits a consumer’s ability to have their products fixed in a timely manner,” the Wayfair class action alleges.
“Commonly, a warrantor’s authorized service centers will have wait times that are untenable for devices that a consumer regularly relies on,” states the Wayfair class action.
Galante claims Wayfair is violating the Magnuson-Moss Warranty Act. She is demanding a jury trial and requesting declaratory and injunctive relief along with an award of equitable relief for herself and all class members.
More than 180,000 Bestar brand wall beds were recalled in April after a woman died when one of them fell on top of her. The company said at the time that it received 60 additional reports of injuries caused by its wall beds.

Wayfair refused to cancel an order made on a previous day. It was four harrowing days of phone and texts exchanges to attempt resolution. Order was not canceled but re-routed, whatever that meant. All in all, fraudulent business practices caused me to lose hours/days doing other productive activities.
