Pine-Sol bacteria class action lawsuit overview: 

  • Who: Charles Scandore filed a class action lawsuit against The Clorox Co. 
  • Why: Scandore claims Clorox failed to disclose to consumers that using its Pine-Sol product could lead to invasive, and potentially fatal, infections. 
  • Where: The class action lawsuit was filed in New York federal court. 

The Clorox Co. misleads and deceives consumers by not disclosing that accidentally ingesting its Pine-Sol cleaning products can increase the risk of contracting invasive infections due to the presence of bacteria, a new class action lawsuit alleges. 

Plaintiff Charles Scandore claims consumers who use Clorox Pine-Sol to clean their homes put themselves at risk of serious infections due to the product allegedly possibly containing pseudomonas aeruginosa.

Scandore argues Clorox fails to disclose that its Pine-Sol products either contain or are at risk of containing pseudomonas aeruginosa despite the company specifically listing both the product’s active and inactive ingredients. 

Immunocompromised individuals are especially at risk by using Pine-Sol, the lawsuit states. Their condition makes them “highly susceptible to life threatening diseases and even death” from exposure to pseudomonas aeruginosa, according to the Pine-Sol class action. 

“This is egregious, especially because people are spreading this bacteria all over their homes by using a product that is supposed to clean their home,” the Pine-Sol class action states. 

Pine-Sol bacteria class action claims consumers unknowingly receive ‘contaminated’ cleaning product

Consumers who purchased Clorox Pine-Sol “lost the entire benefit of their bargain” because the product, unbeknownst to them at the time, was “a cleaning product contaminated with a known bacterium that is harmful to consumers health and lives,” the Pine-Sol class action alleges. 

Scandore claims Clorox is guilty of breach of express warranty and in violation of New York General Business Law. She demands a jury trial and requests declaratory relief along with an award of monetary, statutory and punitive damages for himself and all class members. 

Scandore wants to represent a nationwide class and New York subclass of consumers who have purchased Clorox Pine-Sol. 

Clorox recalled around 37 million bottles of Pine-Sol earlier this month after determining they may contain bacteria that can lead to infections and cause adverse health effects in individuals with weakened immune systems.
