mcdonald's fast food restaurant exteriorMcDonald’s Corporation has been hit with a class action lawsuit by a customer who claims that the restaurant charged him $1.89 for a Sausage McMuffin, even though they advertise the price on the “value menu” at $1.

In September 2018, plaintiff S.D. states that he visited a McDonald’s in California and was shown an advertisement that the Sausage McMuffin was part of a value menu and would cost $1. 

Based on the advertised price, the plaintiff decided that he would purchase two Sausage McMuffins.

However, after leaving the restaurant, S.D. says he noticed that he was actually charged $1.89 for each Sausage McMuffin.

“Had Plaintiff known that Defendant would charge Plaintiff more than Defendant had represented for the Class Products, he would not have purchased the Class Products from Defendant’s restaurant,” the McDonald’s class action lawsuit states.

The plaintiff claims that he was never informed, either in writing or orally, that he would be charged more than the advertised price before he purchased the breakfast item.

In addition, the plaintiff argues that he felt “ripped off and cheated” by McDonald’s for charging more than what was represented to him. 

S.D. believes that McDonald’s will continue to trick customers into purchasing Sausage McMuffins at a higher price than advertised.

“As a result of Defendant’s fraudulent practices, described herein, Plaintiff has suffered economic loss, emotional distress, wasted time, and anxiety,” the McDonald’s class action lawsuit argues.

The McDonald’s class action lawsuit states, “Consumers rely on the representations and advertisements of restaurants in order to know which products to purchase. Details as to the price are important and material to consumers at the time they purchase food from a particular restaurant.”

The plaintiff alleges that McDonald’s knew that the representations that were made about the price of the Sausage McMuffin was not true and intentionally made them in order to deceive their customers.

The McDonald’s class action lawsuit alleges that the restaurant will continue to engage in these misleading practices and will not stop unless forced to do so by a court.

“Defendant’s conduct will continue to cause irreparable injury to consumers unless enjoined or restrained,” the McDonald’s class action lawsuit argues.

In addition, the plaintiff contends that McDonald’s actions only benefit them and provide no benefit to any consumer.

“In fact, knowing that Class Products were not of this price, Defendant unfairly profited from their sale. Thus, the injury suffered by Plaintiff and the members of the Class is not outweighed by any countervailing benefits to consumers,” the McDonald’s class action lawsuit claims.

The plaintiff states that McDonald’s has violated the California Unfair Competition Law, False Advertising Law, and the Consumer Legal Remedies Act.

Potential Class Members include: “All consumers, who, between the applicable statute of limitations and the present, purchased Class Products in the state of California and were charged in excess of the price represented by Defendant.”

    Wow so when did a hashbrown cost more than a McMuffin? I went this morning after seeing a commercial about the breakfast value menu to find out after I ordered and paid that there is no such thing anymore. The store says $1,$2,$3 menu but I was charged $1.79 per hashbrown. Although the McMuffin was held up to the 2 for $3 they are not edible. They are rubbery and dry. What happened to McDonald’s? Different prices each day or block. Bad quality of food and prices all around. It’s such a shame on the old McDonald’s name.

    McD’s is offering ANY size drink for $1. Order a sweet tea and you’re hit with $1.89. I would be more than happy to get you proof of their illegal business practices.

    I have been using the app to take advantage of the “deals” they offer, usually buy this get that free. In the app, it shows my total charge is as it should be, but charges my debit for the full amount as if I had ordered at full prices without their “deals”. Most of the items I would not have ordered, or gone there at all, had it not been for the deals advertised as free or discounted. I am not sure how many times this has happened, as I just caught it last night. The manager said they have no control over it and nothing they can do about it, refusing to refund the charge or remove the item off my order. He said I’d have to request a refund in the app. In the app, it says to contact my bank. I use a prepaid debit for that app, so IDK how that’s going to work … Not to mention how many times they missed putting my ‘free’ item in the bag at all, and I didn’t bother to go back for it (yet now thinking I probably paid full price for it)

    McDonald’s advertises a value ice cream deal for app users, purchasing their ice cream at half off. Even though the app advertises the ice cream at 89 cents, they charge you a $91 total on your card. It’s dishonest, deceitful, and when I presented the Is discrepancy between my receipt and compared it with my credit card statement the McDonald’s manager said I’d have to take it up with the corporate office. I emailed corporate and have never heard back from them. This happened every time I use the app, potentially hundreds of thousands or millions of times to customers who purchase this item each day!

    4/11/22 @ 0648 Sparta, Wisconsin McDonald’s. I ordered 1 of each of the advertised $2.00 bundles listed on their sign. I was charged $ 5.28. I asked why when they are $2.00 each. Gal told me yeah the are now $2.50. Per bundle starting today..I told her she couldn’t do that with the sign advertising $2.00. She charged my card the 5.28 and never said another word. Just handed me my food. The way she handled the situation was not right. I’m not losing sleep over a buck, it’s just wrong tho. Also, no receipt was given nor offered.

    I noticed that just recently they stopped giving the menu deal if you use a deal on the app. Ordered $3 bacon cheeseburger bundle and used rewards to get free filet o fish, charged $5+ due to charging for each at regular price. Today got 2 sausage biscuits for $2…NOT! Charged $1.89 each! I’m about done with mcd!!

    I was up charged $.89 for a medium coffee on a breakfast meal. Meal listed as $6.99 + $.89 for coffee. + $.47 PA state tax. (So they are collecting %6 State tax on extra charge.. that .0534 cents for the state). I was never asked what size I wanted. When I call the manager, they seamed to think it was for cream and sugar.

    just went to Mc ds in quinton va got a spicy chicken sandwich combo and mcflurry 6.99 and 2.49 why tf was i charger 14.00 buck i can eat one person at red lobster for that f n redicklious man i want this fixed rite away Thank u have a good day.

    Just left McDonald’s in claremont nh.ordered 2 sausage egg biscuits and 2 hash browns.was charged 8.38 for 2 biscuits.charged 3.98 for 2 hash browns.total of 13.41.hash browns are 1.09 each and the sausage egg biscuit is 2.79 on menu.when we questioned prices at the window they simply said prices went up.still doesn’t add up with prices on their menu and online menu as well.have reciept and it also says on top buy one get one free sandwich of equal or lesser value.they are doing this to everyone here in claremont.

    Add me please. My charges are always a lot more than it seems they should be- what used to be around a 25.00 bill is now almost 40.00. There is no way it can be right most of the time, but such a hassle to complain and try to straighten out and they know it.
