International Delight French Vanilla Coffee Creamer class action lawsuit overview: 

  • Who: Rosita English filed a class action lawsuit against Danone North America Public Benefit Corporation. 
  • Why: English claims International Delight’s French Vanilla Coffee Creamer is actually a coffee whitener. 
  • Where: The class action lawsuit was filed in New York federal court. 

French Vanilla coffee creamer manufactured and sold by International Delight is actually a coffee whitener, a new class action lawsuit alleges. 

Plaintiff Rosita English claims International Delight misrepresents its French Vanilla coffee whitener as a coffee creamer because it “lacks cream or dairy ingredients beyond a de minimis amount of sodium caseinate.” 

English argues that International Delight uses water and palm oil as a substitute for dairy cream to reduce costs yet still markets the product as a coffee creamer and sells it alongside dairy products. 

“Reasonable consumers must and do rely on a company to honestly and lawfully market and describe the components, attributes and features of a product relative to itself and other comparable products or alternatives,” the International Delight class action states. 

International Delight class action claims ‘coffee creamer’ worth ‘materially less’

English argues that, due to the alleged misrepresentation by International delight, its product is worth “materially less” in value and that the company was able to sell more and for a higher price than it otherwise would have been able to. 

“Had Plaintiff known the truth, she would not have bought the Product or would have paid less for it,” the International Delight class action states. 

The French Vanilla “coffee creamer” is sold at a “premium” price as a result of “the false of the false and misleading representations,” the lawsuit alleges. 

English claims International Delight is guilty of fraud, unjust enrichment and breaching express warranty and in violation of multiple state consumer fraud acts and the Magnuson Moss Warranty Act

Plaintiff is demanding a jury trial and requesting declaratory relief along with monetary, statutory and/or punitive damages for herself and all class members. 

English wants to represent a Texas class and multistate consumer fraud class of individuals who have purchased International Delight’s French Vanilla Coffee Creamer.

In 2018, consumers filed a separate class action lawsuit against Coffee-mate over claims the company’s coffee creamer misrepresented that it was free of trans fat

      Add you to a law suite that’s a joke. No wonder these companies are closing. Bad enough since Covid they have fewer employees, but all of a sudden you “Karen’s” just realized it’s a Non-Dairy product? I’ve enjoyed it for years and the price is high because of inflation and forcing companies to pay double min wage, which means all the other employees have to get a raise. What did you think would happen? I hope this gets thrown out and an attorney sees my comment.

    Dont you fools realize that the only ones to make anything off of these frivolous lawsuits are the Lawyers. This products fits the definition of coffee creamer. I have known for years that it didn’t contain cream. I read the label. I hope all of you fools are stuck using coffee mate for the rest of your lives.
