American Tuna Class Action Lawsuit Overview:
- Who: Jeffrey Craig has filed a class action lawsuit against American Tuna, Inc.
- Why: The plaintiff alleges the company deceives customers with its labeling and marketing as it sources tuna from international waters.
- Where: The class action lawsuit is pending in New York federal court.
American Tuna represents that its tuna is caught in America, and therefore caught in American waters when it is not, a new class action lawsuit claims.
The company also represents that its tuna is canned in America when much of it is canned in Thailand, Costa Rica, Vietnam and other countries.
“All American Tuna brand products are labeled ‘Caught and Canned in the USA,’ ‘Caught and Canned in America,’’ ‘American Made’ or ‘100% American Made,’” the lawsuit states. “In reality, however, American Tuna sources an enormous volume of tuna from international waters and the territorial waters of other countries, and much of this tuna is canned in other countries as well. As a result, American Tuna is deceiving consumers …”
On behalf of himself and other members of the New York Subclass, Plaintiff Jeffrey Craig seeks to enjoin defendant’s unlawful acts and practices described herein, to recover their actual damages or $500, whichever is greater, three times actual damages and reasonable attorneys’ fees.
“Plaintiff and members of the New York subclass suffered an ascertainable loss caused
by defendant’s misrepresentations because they paid more for the American Tuna Products than they would have had they known the truth about the products,” according to the lawsuit.

I made the decision to buy this expensive tuna years ago based on the company’s claim that it was caught and canned in the USA, and recommend it to my family and friends. Seeing this class action suit makes me so angry that I was duped into believing what American Tuna advertised. If this lawsuit turns out to be proven true I will have risked my family’s health and at the very least wasted my money on this very expensive tuna. I plan to follow this case, and in the meantime not take the risk of buying anything else from American Tuna.
I have been buying this tuna for years. The selling point has been their claim that the tuna is caught and processed in the USA. I am so angry that this is false advertising.
Has this suit been determined to be valid? I have been enjoying this tuna for years, thinking it is safe to eat, as well as more tasty
then the usual brands! I try to buy as many things from USA as possible…our country needs support more than ever now!!
