HP class action lawsuit overview:

HP Inc. represents that its laptops will function reliably for a reasonable period of time but fails to disclose that they contain defective lithium batteries that affect the battery life, a class action lawsuit alleges.

Plaintiff Rafael Hernandez filed the HP class action lawsuit Oct. 25 in Florida federal court after his HP Pavilion 15 series laptop allegedly failed to hold battery charge for a reasonable period of time after only a few months of normal usage.

“A laptop’s battery is its most important feature, allowing use of the computer without a power source,” the HP class action states. 

Laptop users expect the battery to function for the reasonable lifespan for a laptop and not prematurely degrade or fail, according to the HP class action lawsuit.

HP lithium ion battery defect makes laptop worth less than plaintiff paid for it, class action says

Hernandez says he purchased the HP laptop because he expected the components, including the HP lithium ion battery, to be adequately designed, manufactured and tested to ensure that it would reliably hold its charge when not connected to an external power source during normal use.

The value of the HP laptop Hernandez purchased was less than the premium price he paid for it, the HP class action lawsuit alleges.

The HP lithium ion battery class action lawsuit asserts claims for violations of the Florida Deceptive and Unfair Trade Practices Act, violations of various state consumer fraud acts, breach of warranty, negligent misrepresentation, fraud and unjust enrichment.

Last year, a federal judge in Washington rejected Amazon’s attempt to dismiss a lithium ion battery class action lawsuit.

    I purchased a new hp laptop less than two years ago expecting up to 6 hours of life between charges as advertised . It never got better than two and now requires a charger almost constantly.

    I have a hp 15 dy2042nr that the battery dies within 20 of use. It’s an internal battery and has to be sent back to be changed
    I paid almost 600 for this laptop and can’t use it unless it’s in the charger. Please add my name also.
