Belkin power bank class action lawsuit overview: 

  • Who: A Belkin power bank consumer is suing Belkin.
  • Why: The plaintiff says the power of the chargers is falsely advertised.

Belkin power banks are falsely marketed as containing more “juice” than they actually have, a new class action lawsuit alleges.

Plaintiff Dennis Gromov filed the class action lawsuit against Belkin International Inc. Dec. 9 in an Illinois federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, Belkin manufactures and sells chargers for portable electronic devices. The packaging of Belkin’s chargers, or power banks, misrepresents the capacity of their power banks, the lawsuit alleges. 

“In fact, the capacity of Belkin’s power banks is significantly lower than represented to consumers,” Gromov alleges. 

“The consumers that buy those power banks are harmed by receiving products inferior to what they believe they are buying.”

Belkin overstates its power banks ability to recharge devices, class action lawsuit states

A power bank’s ability to recharge a device is typically measured and stated in milliampere-hours (mAh), the lawsuit states.

“For greater profit and a larger market share, Belkin exploits consumers’ preferences for power banks that provide more mAh,” Gromov says.

“Belkin intentionally deceives consumers by misrepresenting the amount of power its Products can transfer to PEDs. Belkin advertises its Products as more capable of providing more mAh than its Products are able to provide.”

Gromov said an outside laboratory performed tests on a range of Belkin batteries and found that all of the batteries delivered a lower mAh than advertised. 

“100% of the tested Products failed to measure up to Belkin’s claims,” the lawsuit states, pointing to products that advertised 10,000 mAh and only delivered 6,464 mAh. 

Gromov is suing on behalf of all consumers who bought a Belkin power bank in Illinois, plus a multistate class of consumers from Florida, Massachusetts, Missouri, New Jersey, New York, North Carolina, Ohio, Washington, and Wisconsin.

He is suing for violations of state consumer laws, breach of warranty and unjust enrichment. Gromov seeks certification of the class action, damages, fees, costs and a jury trial.
