Vivid Seats fees class action overview:

  • Who: A Vivid Seats ticket customer sued the ticketing company
  • Why: The plaintiff says Vivid Seats uses “bait-and-switch” tactics, deceiving consumers by showing artificially low prices and then adding fees at the last step of the transaction.
  • Where: The case was filed in California federal court.

A customer who used Vivid Seats is suing the ticketing company, saying it tricks customers by showing artificially low prices for tickets then heaping fees on at the final step of the transaction, according to a new class action lawsuit. 

Plaintiff Brent Dennard filed the class action complaint in Orange County’s Superior Court in late April, alleging violations of state and federal consumer laws, TicketNews reports. The case was transferred to California’s Central District Court in late May.

Dennard said he shopped for tickets in March. He says he found a pair of tickets marketed as costing $21 each on the Vivid Seats website.

However, after he selected the tickets, created an account on the website, entered his billing information and proceeded to the final confirmation page, the price had jumped from $42 for two tickets to $59.80, he says.

Dennard alleges that Vivid Seats “lures” consumers into purchasing tickets by making them believe they can be purchased for far less than their actual cost. 

He says some customers may not realize the fees are added at the final step of the transaction.

“Because Vivid intentionally hides additional fees in a separate link that is not automatically presented to customers as part of the transaction, reasonable consumers are drawn in by deceptively low ticket prices advertised in an initial search and then proceed through check out without ever becoming aware of the amount of the so-called ‘service’ and ‘electronic transfer’ or ‘mobile delivery’ or ‘Flash Seats’ fees that have automatically been included in the total price,” the class action says.

Dennard seeks to represent all consumers in California who have purchased tickets from Vivid Seats in the last four years.

Meanwhile, consumers who purchased tickets from Vivid Seats for events that were canceled due to the coronavirus pandemic were eligible to benefit from a $7.5 million event cancellation class action settlement. That settlement is now closed.

    Please add me. They included hidden fees that made my ticket go originally from $51 to a purchase price of $56 each and then with the service fees a final price of $75 for one ticket! The tickets were not sold out and I later found out the venue had tickets on their own site starting at $40 with a $9 service fee coming from the same vendor See tickets.

Just purchased 2 tickets for a show in LA @ $273 each, total after clicking ‘pay’ was $726, can’t get a detailed receipt even after 40 minutes on phone with ‘customer service’ where I was also told ‘managers and supervisors are not taking calls’ from a call bank in the Philippines.
