- A federal judge in Texas declined to dismiss a class action lawsuit filed against Apple by a man claiming his iPhone 6 exploded in his hand.
- U.S. District Judge Amos L. Mazzant III ruled the man made plausible class claims under the Texas Deceptive Trade Practices Act in his second amended complaint.
- Plaintiff Robert Franklin claims Apple tricked consumers into believing its iPhone 6 batteries were high-quality when, in reality, they can explode.
- Judge Mazzant initially dismissed class claims last October but allowed them to remain following an amended complaint in January.
- Franklin claims he still suffers from injuries to this day on account of his iPhone 6’s battery exploding.

A defect in the Apple iPhone 6 battery caused one iPhone owner’s phone to catch fire in his hands, burning his eyes and wrist, a new class action lawsuit alleges.
The class action lawsuit was filed in Texas on May 6 by lead plaintiff Robert Franklin, who says his iPhone injured him in August 2019.
According to the claim, a defect in Apple’s iPhone 6 battery causes it to overheat, which creates a danger of explosion and fire.
On Aug. 15, 2019, Franklin, who had bought his iPhone 6 in 2018, was listening to music on the phone when he noticed the music playing on his iPhone began to skip, the class action lawsuit states.
“As he picked up his iPhone to investigate, his iPhone suddenly exploded and caught fire in his face, causing him to fall to the ground,” the claim says.
“In an attempt to mitigate his fall, Mr. Franklin instinctively tried to brace himself with his right hand. When Mr. Franklin fell to the ground, he immediately felt a burning pain in his eyes and right wrist. Mr. Franklin suffered injuries to his eyes and wrist as a result of this incident, and these injuries continue to plague Mr. Franklin to this day.”
The class action alleges Franklin’s iPhone 6 was unsafe to operate and was destroyed by the explosion due to the battery defect. The lawsuit adds he incurred economic loss damages associated with the loss and replacement of his iPhone 6 and subsequent medical treatment for his injuries.
“Members of the putative class have the same defective iPhone 6 battery and will incur substantially similar economic loss damages associated with the loss and replacement of their iPhone 6s and possible medical treatments.”
The class action lawsuit alleges consumers were provided an express warranty at the time of sale of the iPhone 6, and Apple warranted the iPhone 6 would be free from defects, meet design specifications, and be suitable for its intended purpose.
“Moreover, Defendant warranted that it would pay the expenses associated with any product defect and needed repair.”
Franklin wants to represent anyone in Texas who bought an iPhone 6 with a defective battery. He is suing for breach of warranty and deceptive trade practices, and seeks certification of the Class, damages, interest, and a jury trial.
Apple has faced a number of class action lawsuits over its iPhone batteries. In January, consumers in Italy filed a €60 million (roughly $73 million) class action lawsuit over its iPhones’ battery life, alleging Apple’s “planned obsolescence” of several models of the iPhone 6 that were sold in Italy between 2014 and 2020.

I had to get another phone because my apple6 phone battery started acting up overheated. I thought it was my fault. I never know what to expect. I took it to the store and complained they told me it’s too old can’t be repaired. I had to get another one so I did. They offer me another one I think that was an 8 it was too expensive. Than I took a 7 for $800 than someone told me that how apple do to make you buy new phone. I couldn’t even afford new phone at the time. I had to used a credit card.

We had 3 iPhone 6 plus 1 after the other the battery life went then the screen would blank out and then the batteries began swelling and puffy and me please
I had a iPhone 6 Plus and it would not hold a charge.. at times the whole phone would get too hot, like it had been on a stove… at times, it would shut off and it would be hard to cut it back on
My iPhone 6 gets real hot also please add me i have called and complained and they have done nothing for me to resolve this issue.

My husband has an IPone 6. He has had to replace the battery. His music is extremely bad. He has all kinds of problem with it
My Apple iPhone 6s Plus will not hold a charge and must recharge every day. Sometimes it gets warm also.
I have and am still using my iPhone 6 and it don’t hold a charge at all and gets so hot to even touch at times and it does this several times on a daily basis with and with out of on a charger. I can just b checking email nn all of a sudden it rapidly gets extremely hot n jus secs. I never understood why it did that either.
My iPhone 6s Plus battery is about to explode! It expanded and broke the iPhone!
