Sazerac Co. misleads consumers who expect mini bottles of its Fireball Cinnamon product to contain whisky, a new class action lawsuit alleges. 

Plaintiff Anna Marquez claims Sazerac misleads consumers who confuse its Fireball Cinnamon mini bottles — a malt beverage sold for 99 cents — with its Fireball Cinnamon Whisky product. 

Marquez argues the bottles for Fireball Cinnamon “appear identical” to the Fireball Cinnamon Whisky product, aside from them not containing the word “Whisky” on their front label, something “most purchasers seeking alcohol will not even detect.” 

“When viewed together with the Fireball distilled spirit brand name, the label misleads consumers into believing it is or contains distilled spirits,” the Fireball class action states. 

Fireball Cinnamon purchasers led to believe product has added natural whisky, class action says

Sazerac further misleads consumers by labeling its Fireball Cinnamon product with the words “Malt Beverage With Natural Whisky & Other Flavors and Carmel Color,” confusing purchasers into thinking it is a malt beverage with added natural whisky, the Fireball class action alleges. 

“By not including the word ‘Flavors’ after ‘Natural Whisky,’ purchasers who look closely will expect the distilled spirit of whisky was added as a separate ingredient,” the Fireball class action states. 

Marquez claims Sazerac is guilty of unjust enrichment, fraud and negligent misrepresentation and in violation of the Magnuson Moss Warranty Act, the Illinois Consumer Fraud and Deceptive Business Practices Act and several state consumer fraud acts. 

Marquez wants to represent an Illinois class and multistate consumer fraud class of individuals who have purchased a mini bottle of Fireball Cinnamon within the statutes of limitations for each alleged cause of action. 

She demands a jury trial and requests injunctive relief along with an award of monetary, statutory and/or punitive damages for herself and all class members. 

In other booze news, last month, Coca-Cola asked a federal judge in New York to dismiss claims it misleadingly labels its Topo Chico brand ready-to-drink hard margherita products because they don’t contain any tequila.

      I live in Arkansas within the last year and a half to two years I have purchased at least 3 bottles of the fireball. I can tell you it was only these few times due to the fact of trying the product in
      attempt to drink shots for a head change which never never came, again I purchased it to try again on the third attempt when nothing came of my attempt for a head change through shot or two and nothing happened three strikes your out . Here’s the thing I never felt any effect from what should have been from the few shots the bottle offers . Now I know why that was ! Honestly wow. ! So misleading ! Coming out after introducing real whiskey product getting us aware of your product then coming in with this crap ! Wow

      I bought my first fake fireball about 2 yrs ago when I was traveling and I bought a 10 pack and after 6 or 7 i had NO BUZZ and I felt really sick
      No to my knowledge at that time it was malt liquor. Last yr they started selling them at the gas stations and 7-Elevens in my area which is around Buffalo New York and I noticed that it was all malt liquor after I had spent probably 50 bucks on them. The real fireball and the fake fireball. It stopped made me really sick it was the worst stuff in the world it gave me a terrible bad headache and sick to my stomach.

    I’m a huge alcoholic, and actually have some liver damage. I realized that a long time ago I have always talked shit that it was watered down, never got the taste that I get from my big bottles. I drink a $20 bottle everyday from the liquor store. The one’s in deli’s/ grocery stores are fake , I can’t believe finally someone made a lawsuit about this. I knew they were watered down!!!!! Unbelievable!!!!!!

    This is the only alcohol I drink. I get the mini bottles all the time at Kroger. I love the cinnamon drink

    I have been purchasing the little bottles for the last two year by the packs, buckets and gift packs, believing I was purchasing real Fireball Whiskey. These little bottles became a contributing factor in me becoming an alcoholic because of the convenience of the little shooter bottles. Please add me to the lawsuit. False impressions of what is being bought and was decieved.

      I buy these all the time from the dollar general and family dollar store I still have some from the holidays the rest I gave for gifts I new it tasted different than that we bought at the liquor store had me cause I gave it as stocking stuffers to my family and friends
