A class action lawsuit alleges that Bulletproof Cold Brew Coffee contains too much saturated fat to be considered healthy and based on some claims about the product’s health benefits, should be classified as a drug.

Plaintiff Tiffni Altes says she purchased Bulletproof Cold Brew Coffee products at least twice in the last two years at a Whole Foods in California.

According to the Bulletproof Cold Brew Coffee class action, Altes purchased the products at least in part because of how they were advertised. 

Altes states that she was financially injured because had she known that Bulletproof coffee contained unhealthy amounts of saturated fats and the health benefits were falsely advertised, she would not have purchased the product or would not have paid as much for it as she did.

She says that because of Bulletproof 360’s false claims, “she was denied the benefit of the bargain when she decided to purchase Bulletproof Cold Brew products instead of other coffee products which are neither unlawful or falsely advertised.”

Altes argues that many other consumers were similarly misled and financially injured. She seeks damages on behalf of herself and all affected consumers.

The Bulletproof class action lawsuit says Bulletproof falsely claims that its products are a healthy alternative to regular coffee.

Allegedly, Bulletproof contains 40 percent of the FDA-recommended daily amount of saturated fat.

Additionally, Altes says that Bulletproof’s labeling makes claims that it can limit cravings and can give a user energy all day long.

The Bulletproof coffee class action lawsuit argues that these are drug claims, and therefore, the product should be approved by the FDA as a drug.

Altes goes on to argue that “Bulletproof Cold Brew Coffee is not generally recognized, among experts qualified by scientific training and expertise to evaluate the safety and effectiveness of drugs, as safe and effective for use under the condition recommended by its labeling.”

Allegedly, the product does not comply with FDA regulations and the founder of Bulletproof 360 calls the FDA and its regulations “antihuman.”

Altes argues that Bulletproof 360’s lack of regard for FDA regulations and the false claims made in the cold brew’s advertising endangers the health of its consumers, and unfairly gives Bulletproof an advantage over competitors that do comply with state and federal law.
