Summer’s Eve Body Spray Benzene Class Action Lawsuit Overview: 

  • Who: Gwen Sullivan filed a class action lawsuit against Prestige Consumer Healthcare Inc. 
  • Why: Sullivan claims Prestige markets and sells a certain Summer’s Eve brand body spray containing benzene, a known human carcinogen.
  • Where: The lawsuit was filed in New York federal court.

Prestige Consumer Healthcare markets and sells certain Summer’s Eve brand body sprays without disclosing they contain benzene, a known human carcinogen, a new class action lawsuit alleges.

Plaintiff Gwen Sullivan claims Prestige misleads consumers by failing to disclose that its Summer’s Eve – Ultra Freshening Spray, 5-in-1 body spray is contaminated with benzene. 

The benzene contamination came to light following the results of a study released last year by Valisure, an independent analytical pharmacy, which revealed a number of cosmetic, health and spray products contained benzene. 

Sullivan claims she would not have been willing to purchase the Summer’s Eve body spray had she known it contained benzene, calling it “worthless.” 

“The Product Plaintiff received were worthless because they contain the known carcinogen benzene,” the class action lawsuit states.

Benzene In Summer’s Eve Bidy Spray A ‘Widely Recognized And Incredibly Dangerous Substance’

Benzene is a “widely recognized and incredibly dangerous substance” that has been linked to a variety of health concerns, including cancer such as leukemia, according to the class action lawsuit. 

Despite this, Sullivan argues Prestige markets and advertises the Summer’s Eve body spray towards “health-conscious consumers” all while failing to disclose that it contains benzene. 

“Plaintiff and Class Members relied on Defendant’s misrepresentations and omissions of what is in the Product when they purchased it,” the lawsuit states. 

Sullivan claims Prestige is guilty of fraudulent concealment, breach of express warranty and unjust enrichment and in violation of New York General Business Law

Sullivan wants to represent a nationwide class and New York subclass of consumers who have purchased Summer’s Eve – Ultra Freshening Spray, 5-in-1 body spray. 

Plaintiff is demanding a jury trial and requesting monetary, treble, statutory and punitive damages for herself and all class members. 

A number of class action lawsuits have been filed in the wake of the Valisure study, including CVS, Procter & Gamble and Bayer, among others.

    I was wondering who would I need to contact, I have had problems for years using Summer’s Eve spray. I just stopped using it on last year and I want to be part of the class action lawsuit.

      Wonder what happened to this. I got bad chemical burns that turn to cellulitis and haven’t fully gone away.

      Just had a skin biopsy done, they were looking for a rare skin cancer and it came back as a mild chronic Spongiotic Dermatitis and I been using summer’s eve feminine wash for over 20years.
