Pantene Pro-V Nature Fusion Class Action Lawsuit Overview:

  • Who: Pantene Pro-V maker, Procter & Gamble, scored a win in a class action accusing it of falsely advertising its Nature Fusion line.
  • What: A federal judge found the plaintiffs had failed to show that they were duped by advertising claiming the hair care products were natural, but Class Members may have another chance. 
  • Where: The Pantene Pro-V lawsuit is pending in California federal court. 

Consumers have not convinced the court that Procter & Gamble Co. tricked them into believing Pantene Pro-V “Nature Fusion” shampoo was natural, but plaintiffs can have 21 days to file an amended class action complaint, a California federal judge has ruled. 

On Tuesday, U.S. District Judge Yvonne Gonzalez Rogers granted a motion to dismiss the Pantene Pro-V lawsuit filed by a consumer against Procter & Gamble. in 2020. 

Consumers Duped About Hair Care Line, Claims Pantene Pro-V Lawsuit

Lead plaintiff Sean McGinity said he purchased Pantene Pro-V Nature Fusion shampoo and conditioner products in June 2019 at a premium price, based on representations that the products were from “nature.” 

He alleged that the hair products were deceptively marketed and not worth the higher price point because they contain “non-natural and synthetic ingredients, harsh and potentially harmful ingredients, and are substantially unnatural.”

Pantene Pro-V Nature Fusion products contain numerous synthetic ingredients such as synthetic fragrance, dyes, surfactants, and preservatives, claimed the lawsuit. 

Some of the ingredients, including the synthetic dyes, are reportedly produced from unnatural sources such as petroleum or coal tar. Based on these ingredients, McGinity argued that the personal care products cannot and should not be marketed as natural.

In Tuesday’s order, Judge Rogers said McGinity had failed to allege sufficient facts to show that a reasonable consumer would be deceived by the shampoo and conditioners’ labeling. 

“The court finds that plaintiff has not sufficiently alleged that it is misleading or deceptive for P&G to use the label ‘Nature Fusion’ on its packaging,” she wrote. She gave McGinity 21 days to file an amended complaint. 

Judge Rogers also noted that the court was unconvinced that the word “nature” was synonymous with “natural,” so did not invoke case law around the use of the word “natural” on packaging. 

“Here, plaintiff has not alleged, nor does the court think he could, that shampoos and conditioners occur in nature, and are therefore a byproduct of natural conditions,” Judge Rogers said.  

Shampoos are often at the center of class action lawsuits. In December last year, the maker of Selsun Blue faced a class action lawsuit from a consumer who claims the company’s supposedly natural anti-dandruff shampoo actually contains a number of synthetic ingredients.
