Huda Beauty Eye Makeup Settlement Overview:

  • Who: Consumers who bought Huda Beauty Neon Obsessions eye makeup are asking a judge to approve a $2.8 million class action settlement with the company.
  • Why: The settlement would end claims that Huda Beauty sold products that had pigments that federal regulators prohibited from using around the eyes.
  • Where: The class action is pending in California federal court.

Eye makeup consumers are asking for a judge’s final approval on a $2.8 million settlement that would end class action claims that Huda Beauty sold eye shadows containing ingredients that are prohibited from use around the eyes.

In a motion filed Dec. 17 in a California federal court, Plaintiffs Cristie Ramirez and Natalie Linarte asked the court to give the final green light to a settlement with HB USA Holdings Inc. over its Neon Obsessions line of eye products. 

The settlement would make class members eligible for a payment of $29 for each product, up to a maximum of three products, to a maximum of $87, the proposed settlement says.

Class members who received direct notice via email and mailings would not need to provide proof of purchase while those who did not receive direct notice would need to provide it.

Hidden Disclaimer Says Product Should Not Be Used Around Eyes, Plaintiff Says

Ramirez filed a class action lawsuit in 2020, alleging Huda Beauty’s Neon Obsessions Palette is falsely advertised as being eyeshadow when a hidden disclaimer on the back of the package states that the products should not to be used around the eyes.

The plaintiffs say they used the product as an eye shadow and then suffered physical injuries, including eye irritation.

Ramirez and Linarte had both sued HB USA separately and entered into settlement negotiations. When they found out about the two suits, the claims were consolidated. 

The parties agreed to the settlement deal in June, and preliminary approval was granted in August, according to the motion. Since then, there have been more than 83,000 claims made.

Huda Beauty denies any wrongdoing. 

Ramirez has requested $716,240 for her counsel, Milberg Coleman Bryson Phillips Grossman PLLC, and Linarte requested $467,000 in fees for her counsel, Beshada Farnese LLP.

Settlement class members include consumers who purchased any color of Huda Beauty Neon Obsessions Pressed Pigment Palettes in the United States on or before Aug. 15, 2021.

The deadline to file a claim in the Huda eyeshadow settlement is Jan. 12, 2022. For more information on how to claim, click here

    I was declined due to an alleged deficiency notice that was sent out in Spring of 2022 that I never received. I have asked if it was sent by email or USPS and have yet to hear. I never received anything from this company. More money for the attorney’s I guess.
