Clinique ‘Oil Free’ Class Action Lawsuit Overview: 

  • Who: Clinique moved to dismiss a complaint against it that stated its “oil-free” skincare products contain oils.
  • Why: U.S. District Judge Marvin E. Aspen denied the motion, saying the lawsuit requires “additional factual development.”
  • Where: The lawsuit is pending in Illinois federal court.

Clinique can’t slip out of a class action lawsuit accusing the makeup maker of falsely marketing its products as “oil-free.”

An Illinois federal judge has denied Clinque Laboratories LLC’s motion to dismiss the lawsuit alleging that the labeling on its “oil-free” skin products is misleading because they do, in fact, contain oils.

However, the judge dismissed claims relating to products the lead plaintiff didn’t buy.

“It is not clear that Flaherty ‘knew Clinique’s products contained ingredients she has deemed to be oils’ before she purchased them,” US District Judge Marvin E. Aspen wrote. 

“Additional factual development is needed to determine, among other things, whether Flaherty knew that the Clinique products she purchased contained the offending oils when she purchased them,” continued the order denying Clinique’s motion to strike the class allegations.

Clinique Oil-Free Makeup False Advertising Class Action Lawsuit

Lead plaintiff Norah Flaherty filed the nationwide class action lawsuit claiming that Clinique falsely advertises at least eight products as “oil-free” earlier this year. Flaherty says that she and other consumers paid more for the supposedly oil-free products but were duped by Clinique’s marketing because the items contain oils.  

Flaharty says that she purchased several Clinique makeup products that were labeled “oil-free.” The plaintiff alleges that to her and other consumers, “oil-free” means that the product does not contain ingredients that are “liquid at room temperature, more viscous but less dense than water, do not mix with water, and slick or slippery to the touch.” 

The plaintiff says she paid more for Clinique’s items because she does not like how oil feels on her skin and interacts with other products she uses. However, she says she discovered that the Clinique makeup she bought contains several types of oils.  

The class action lawsuit claims that the following Clinique products contain numerous types of oils, such as dimethicone, isostearyl neopentanoate and tocopherol acetate.

Although many popular skin care brands advertise their products as being oil-free, consumers claim that many “oil-free” creams and moisturizers do, in fact, contain oils. Some have filed class action lawsuits against makeup companies, including Clinique, as well as Neutrogena and CeraVe, claiming they may be engaging in deceptive and illegal labeling techniques in order to fool consumers into purchasing their products.
